AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF THE
NORTHWEST CORNER OF ELM STREET AND BEAUDEAN
LANE, CITY AND COUNTY OF CAPE GIRARDEAU,
MISSOURI FROM R-2 TO R-4

WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 1 of this
ordinance should be rezoned from R-2 Single -Family Dwelling
District to R-4, Multiple Dwelling District; and
WHEREAS, Public Notice of such change was given as prescribed
in Chapter 30 of the Code of Ordinances of the City of Cape
Girardeau, Missouri, and public hearing was held on Monday, May 1,
2000; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in Article 1
from R-2, Single -Family Dwelling District to R-4, Multiple Dwelling
District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the City of
Cape Girardeau, Missouri, is hereby amended to change the zoning
from the present R-2, Single -Family Dwelling District to R-4,
Multiple Dwelling District, for the following described property:
The South 132 feet of the East 666.6 feet of Out Lot
Numbered Forty-five (45) in the City and County of Cape
Girardeau, Missouri, being further described as follows:
Beginning at the Southeast corner of said Out Lot No. 45;
run thence North 820 05' 00" West along the South line of
Out Lot 45, 666.60 feet; thence North 70 03' 00" East,
132.00 feet; thence South 820 05' 00" East, 666.60 feet;
thence South 70 03' 00" West, 132.00 feet to the point of
beginning.
Except that part which lies in Beaudean Street right of
way. Subject to terms, conditions, restrictions and
reservations of record, if any.
ARTICLE 2. The City Council hereby finds and declares that the
property described in Article 1 hereof is at the present time
particularly suitable for the purposes and uses of R-4, Multiple
Dwelling District, and that such changes authorized hereby are
reasonable and in reasonable conformity with the existing uses and
value of the immediately surrounding properties.
ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
