AN ORDINANCE VACATING THE CITY'S INTEREST IN A PORTION OF A UTILITY EASEMENT IN DKR FIFTH SUBDIVISION, IN THE CITY OF CAPE GIRARDEAU, MISSOURI WHEREAS, the City Council has received a request that the City vacate a utility easement in DKR Fifth Subdivision, and more particularly described in Section 1 hereof; and WHEREAS, the City Council set the date of April 17, 20000, for a public hearing on this request; and WHEREAS, at least ten (10) days notice of the time and place of this hearing was published in a newspaper of general circulation in the City; and WHEREAS, a public hearing was held on April 17, 2000, at which all interested parties were afforded the opportunity to speak in favor of or in opposition to the proposed utility easement vacation; and WHEREAS, the City Council has determined that the utility easement in question is not necessary or needed for the purposes for which it was dedicated and established; and WHEREAS, it is in the public interest that the utility easement be vacated; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1. The City's interest in a utility easement on the following described real estate: That portion of a 10 foot utility easement located on Lot No. 4 of DKR Fifth Subdivision in the City and County of Cape Girardeau, more particularly described as follows: Commence at the Southeast corner of Lot No. 1 of DKR First Subdivision; thence with the East line of said Lot No. 4 of DKR Fifth Subdivision, South 100 38' 47" West, 99.70 feet, to the point of beginning; thence continue South 100 38' 47" West, 161.00 feet; thence leaving said East line, North 790 21' 13" West, 10.00 feet; thence North 100 38' 47" East, 161.00 feet; thence South 79° 21' 13" East, 10.00 feet, containing 1610.0 square feet, more or less.
