AN ORDINANCE VACATING THE CITY'S INTEREST IN A
SEWER AND UTILITY PURPOSES EASEMENT, IN
NORTHFIELD SUBDIVISION, IN THE CITY OF CAPE
GIRARDEAU, MISSOURI ff

WHEREAS, the City Council has received a request that the City
vacate a sewer and utility purposes easement in Northfield
Subdivision, and more particularly described in Section 1 hereof;
and
WHEREAS, the City Council set the date of March 20, 2000, for
a public hearing on this request; and
WHEREAS, at least ten (10) days notice of the time and place
of this hearing was published in a newspaper of general circulation
in the City; and
WHEREAS, a public hearing was held on March 20, 2000, at which
all interested parties were afforded the opportunity to speak in
favor of or in opposition to the proposed sewer and utility
purposes easement vacation; and
WHEREAS, the City Council has determined that the sewer and
utility purposes easement in question is not necessary or needed
for the purposes for which it was dedicated and established; and
WHEREAS, it is in the public interest that the sewer and
utility purposes easement be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City's interest in a sewer and utility
purposes easement on the following described real estate:
[1802 Northbridge Drive] An easement for sanitary sewer,
utility, and purposes over and upon the west ten (10)
feet of the east twenty (20) feet of Lot 69 of Northfield
Subdivision, City and County of Cape Girardeau, Missouri.
is hereby vacated.
ARTICLE 2. This ordinance shall be in full force and effect
ten days after its passage and approval.

City.
