AN ORDINANCE VACATING THE CITY'S INTEREST IN A
SEWER, UTILITY AND DRAINAGE EASEMENT, IN CAPE
WEST THIRD SUBDIVISION AND CAPE WEST EIGHTH
SUBDIVISION, IN THE CITY OF CAPE GIRARDEAU,
MISSOURI
WHEREAS, the City Council has received a request that the City
vacate a sewer, utility and drainage easement in Greater Cape
Girardeau Commercial Center, and more particularly described in
Section 1 hereof; and
WHEREAS, the City Council set the date of March 6, 2000, for
a public hearing on this request; and
WHEREAS, at least ten (10) days notice of the time and place
of this hearing was published in a newspaper of general circulation
in the City; and
WHEREAS, a public hearing was held on March 6, 2000, at which
all interested parties were afforded the opportunity to speak in
favor of or in opposition to the proposed sewer, utility and
drainage easement vacation; and
WHEREAS, the City Council has determined that the sewer,
utility and drainage easement in question is not necessary or
needed for the purposes for which it was dedicated and established;
and
WHEREAS, it is in the public interest that the sewer, utility
and drainage easement be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City's interest in a sewer, utility and
drainage easement on the following described real estate:
A fifteen (15) foot wide sewer, utility and drainage
easement located on the north side of the existing USPS
Area Mail Processing Center, along the north line of Lot
14 in Cape West Third Subdivision and the south line of
Lot 1 in Cape West Eighth Subdivision.
is hereby vacated.
ARTICLE 2. This ordinance shall be in full force and effect
ten days after its passage and approval.
