AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF THE SOUTH
SIDE OF BRENDA KAY COURT, FRONTING ON WEST END
BOULEVARD, CITY AND COUNTY OF CAPE GIRARDEAU,
MISSOURI FROM M-1 TO MH -1
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 1 of this
ordinance should be rezoned from M-1, Light Industrial District to
MH -1, Mobile Home Park District; and
WHEREAS, Public Notice of such change was given as prescribed
in Chapter 30 of the Code of Ordinances of the City of Cape
Girardeau, Missouri, and public hearing was held on Monday, March
6, 2000; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in Article 1
from M-1, Light Industrial District to MH -1, Mobile Home Park
District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the City of
Cape Girardeau, Missouri, is hereby amended to change the zoning
from the present M-1, Light Industrial District to MH -1, Mobile
Home Park District, for the following described property:
THAT PART OF THE SOUTH HALF OF OUTLOT 52, UNITED STATES
PRIVATE SURVEY NO. 2199, TOWNSHIP 30 NORTH, RANGE 14 EAST
OF THE FIFTH PRINCIPAL MERIDIAN, CITY AND COUNTY OF CAPE
GIRARDEAU, STATE OF MISSOURI, DESCRIBED AS FOLLOWS:
Commence at the Southeast corner of Outlot 52; thence
North 81028155" West, 1,306.44 feet along the South line
of Outlot 52 to the East right of way line of West End
Boulevard; thence along said East right of way line,
North 07049138" East, 565.00 feet; thence leaving said
East line. South 81028155" East, 10.00 feet to the point
of beginning; thence North 07049138" East, 271.11 feet;
thence leaving said East line, along the arc of a curve
to the right, having a radius of 20.00 feet, 31.63 feet;
thence South 81033100" East, 79.46 feet; thence along the
arc of curve to the right, having a radius of 170.00
feet, 38.09 feet (the chord of said arc bears South
7500715111 East, 38.01 feet) ; thence along the arc of a
curve to the left, having a radius of 230.00 feet, 51.54
feet (the chord of said arc bears South 75007151" East,
51.43 feet); thence South 81°33'00" East, 777.79 feet;
thence North 07°30138" East, 36.35 feet; thence South
82028133" East, 328.26 feet; thence South 07041130" West
324.53 feet; thence North 81028155" West, 1295.09 feet,
to the place of beginning and containing 9.11 acres, more
or less. Subject to any easements of record.
ARTICLE 2. The City Council hereby finds and declares that the
property described in Article 1 hereof is at the present time
particularly suitable for the purposes and uses of MH -1, Mobile
Home Park District, and that such changes authorized hereby are
reasonable and in reasonable conformity with the existing uses and
value of the immediately surrounding properties.
ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
