ORDINANCE NO. 209 J
AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF 2855, 2861
AND 2911 BLOOMFIELD ROAD, CITY AND COUNTY OF
CAPE GIRARDEAU, MISSOURI FROM R-1 TO R-4
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 1 of this
ordinance should be rezoned from R-1 Single -Family Dwelling
District to R-4, Multiple Dwelling District; and
WHEREAS, Public Notice of such change was given as prescribed
in Chapter 30 of the Code of Ordinances of the City of Cape
Girardeau, Missouri, and public hearing was held on Monday, March
6, 2000; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in Article 1
from R-1, Single -Family Dwelling District to R-4, Multiple Dwelling
District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the City of
Cape Girardeau, Missouri, is hereby amended to change the zoning
from the present R-1, Single -Family Dwelling District to R-4,
Multiple Dwelling District, for the following described property:
Part of Lot Three (3) of Davis Subdivision of a part of
Out Lot 86 in Survey No. 2199 and a part of Survey No.
174, all in Township 30 North, Range 13 East, described
as follows: Start at the southwest corner of said Lot 3,
thence North 40 45' East along the west line of Lot 3,
638.0 feet; thence South 820 0' East 142.0 feet for the
point of beginning; thence North 40 45' East 292.5 feet
for a corner in the south line of Bloomfield Road; thence
along said south line North 810 30' East 115.4 feet and
North 850 30' East 76.7 feet for a corner; thence South
80 0' West 341.5 feet for a corner; thence North 820 0'
West 170.0 feet to the point of beginning and contains
1.31 acre more or less.
Water line easement 15.0 feet in width lying 7.5 feet on
each side of the following described centerline:
Part of Outlot 86 in U.S.P. Survey No. 2199, Township 30
North, Range 13 East, in the City and County of Cape
Girardeau, State of Missouri, described as follows:
Start at the Northeast Corner of Lot No. 7 of Ebert Is
Subdivision of part of Outlot 86 and run South 80 30'
East along the East line of said Lot 7, a distance of 623
feet to a point on the North line of Outlot 86 and on the
South side of Bloomfield Road; thence South 800 30' West,
along the South side of Bloomfield Road 112 feet; thence
South 180 05' East, 449.2 feet; thence South 580 55'
East, 932.4 feet; thence South 160 02' West, 610.3 feet
to a point on the South line of said Outlot 86; thence .
North 810 40' West, 17.0 feet for the point of beginning;
thence North 360 26' East, 26.0 feet; thence North 90 02'
East, 142.6 feet; thence North 170 32' East, 196 feet and
there terminating.
1.4711 acres, more or less, being all that, part of Out
Lot 86 in the City of Cape Girardeau, Missouri, described
as follows: Commence at the point of intersection of the
south side of Bloomfield Road and the East line of Silver
Springs Road; thence Easterly along the South side of
said Bloomfield Road with the following: North 67 deg 00'
East, 184.78 feet and North 81 deg 30' East, 226.38 feet
to an axle for a place of beginning; thence continue
along said road, North 82 deg 39' 53" East, 241.59 feet
to the North side of a concrete post; thence South 4 deg
58149" West, 272.00 feet to a concrete post; thence South
82 deg 36135" West, 240.52 feet to a 1/2 inch iron rod;
thence North 4 deg 45' East, 272.0 feet to the place of
beginning.
ARTICLE 2. The City Council hereby finds and declares that the
property described in Article 1 hereof is at the present time
particularly suitable for the purposes and uses of R-4, Multiple
Dwelling District, and that such changes authorized hereby are
reasonable and in reasonable conformity with the existing uses and
value of the immediately surrounding properties.
ARTICLE 3. This ordinance
ten days after its passage and
