ORDINANCE NO. _12(LIZ)
AN ORDINANCE DECLARING IT NECESSARY TO IMPROVE
THAT PART OF INDEPENDENCE STREET FROM PACIFIC
STREET TO SPRIGG STREET, FOR A DISTANCE OF
APPROXIMATELY 940 FEET, IN THE CITY OF CAPE
GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. That the Council of the City of Cape Girardeau,
Missouri, hereby declares it necessary to improve Independence Street
from Pacific Street to Sprigg Street, for a distance of approximately
940 feet, in the City of Cape Girardeau, Missouri, by grading to the
established grade and constructing thereon a Portland Cement Concrete
Pavement six (6) inches thick and a minimum of thirty-eight (38) feet
in width, including upright curbs, sidewalks, curb ramps and other
necessary appurtenances, which shall be constructed as shown on the
plans and specifications for said improvement which have been filed
with the City Clerk. It is the intention of the City Council to have
this project done by contract and upon completion of the project, the
cost of the proposed work, not to exceed $67.00 per front foot, plus
all land acquisition costs, shall be charged to the abutting property
by the issuance of special tax bills. This $67.00 per front foot
amount, plus all land acquisition costs, is hereby established as the
assessment to be used for this improvement.
ARTICLE 2. That this ordinance be published for seven consecutive
insertions in the Southeast Missourian, a daily newspaper, printed and
published in the City of Cape Girardeau, Missouri, and if a majority of
the resident owners of the lands that would be liable for the costs of
the improvements, at the date of the passage of this ordinance, who
shall own a majority of the front feet owned by the residents of the
City, abutting on the part of said Independence Street proposed to be
improved, shall not within ten days after the last publication of the
ordinance, file with the City Clerk their protest against such
improvements, then the City Council shall have the power to cause the
improvements to be made and assess the costs against the property
abutting on the improvements as provided by law.
ARTICLE 3. A public hearing will be held before the City Council
at 7:30 P.M. on Monday, March 20, 2000, at City Hall, 401 Independence,
Cape Girardeau, Missouri, at which citizens and all interested parties
may be heard on the question of the necessity of the work sought to be
done.

ARTICLE 4. This ordinance shall be in full force and effect ten
days after its passage and approval.
