AN ORDINANCE DECLARING IT NECESSARY TO IMPROVE
THAT PART OF RODNEY STREET FROM THE NATIONAL
GUARD ARMORY TO HAWTHORNE ROAD, FOR A DISTANCE
OF APPROXIMATELY 1,600 FEET, IN THE CITY OF
CAPE GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. That the Council of the City of Cape Girardeau,
Missouri, hereby declares it necessary to improve Rodney Street from
the end of concrete at the National Guard Armory to Hawthorn Road, for
a distance of approximately 1,600, in the City of Cape Girardeau,
Missouri, by grading to the established grade and constructing thereon
a Portland Cement Concrete Pavement seven (7) inches thick and twenty-
eight (28) feet in width, including upright curbs, sidewalks, drainage
structures, replacement of the bridge over Cape LaCroix Creek, and
other necessary appurtenances, which shall be constructed as shown on
the plans and specifications for said improvement which have been filed
with the City Clerk. It is the intention of the City Council to have
this project done by contract and upon completion of the project, the
cost of the proposed work, not to exceed $46.00 per front foot, plus
all land acquisition costs, shall be charged to the abutting property
by the issuance of special tax bills. This $46.00 per front foot
amount, plus all land acquisition costs, is hereby established as the
assessment to be used for this improvement.
ARTICLE 2. That this ordinance be published for seven consecutive
insertions in the Southeast Missourian, a daily newspaper, printed and
published in the City of Cape Girardeau, Missouri, and if a majority of
the resident owners of the lands that would be liable for the costs of
the improvements, at the date of the passage of this ordinance, who
shall own a majority of the front feet owned by the residents of the
City, abutting on the part of said Rodney Street proposed to be
improved, shall not within ten days after the last publication of the
ordinance, file with the City Clerk their protest against such
improvements, then the City Council shall have the power to cause the
improvements to be made and assess the costs against the property
abutting on the improvements as provided by law.
