AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A
GENERAL WARRANTY DEED FOR DISPOSAL OF AN UNECONOMICAL
REMNANT PURSUANT TO A PROPERTY ACQUISITION AGREEMENT
FOR THE CAPE LA CROIX CREEK/WALKER BRANCH FLOOD CONTROL
PROJECT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, in accordance with a
certain formal agreement by and between Albert M. Spradling, III and Pamela S.
Spradling, and the City of Cape Girardeau, hereby authorizes the City Manager to
execute a General Warranty Deed (by corporation) which when executed, will convey
a strip of land from the Walker Branch portion of the Cape La Croix Creek/Walker
Branch Flood Control Project, which strip of land is more particularly described as
follows, to -wit:
ALL THAT PART OF OUT LOT NUMBER 80 OF UNITED STATES
PRIVATE SURVEY NUMBER 2199, TOWNSHIP 31 NORTH, RANGE 13
EAST OF THE FIFTH PRINCIPAL MERIDIAN, IN THE CITY AND
COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI, DESCRIBED AS
FOLLOWS:
Commence at a 6" x 6" concrete monument with steel center, marking the
Northeast corner of said Out Lot 80, thence with the North line of said Out
Lot, North 8205853" West, 383.47 feet to a 1/2" diameter iron rod marking
the Northwest corner of Lot Number 3 of Walker's Subdivision; thence with
the West line of said Lot Number 3, South 07012'08" West, 708.23 feet;
thence North 89026'53" West, 51.10 feet to the place of beginning; thence
continue North 8902653" West, 32.16 feet to the Northeast corner of a tract
of land described in Deed Book 442 at Page 829 in the office of the Cape
Girardeau County Recorder of Deeds; thence with the East line of said
tract, South 4104645" West, 340.48 feet; thence South 44018'18" East,
14.60 feet; thence North 45041'42" East, 89.68 feet; thence North
42030'44" East, 273.23 feet to the place of beginning and containing 7444
square feet, more or less.
ARTICLE 2. This ordinance shall be in full force and effect ten days after its
passage and approval.
