AN ORDINANCE VACATING THE CITY'S INTEREST IN A
SEWER, UTILITY AND DRAINAGE EASEMENT, IN CAPE
WEST 8TH SUBDIVISION, IN THE CITY OF CAPE
GIRARDEAU, MISSOURI 001 0,0012011
WHEREAS, the City Council has received a request that the Cit
vacate a Sewer, Utility and Drainage Easement in Cape West 8t
Subdivision, and more particularly described in Section 1 hereof;
and
WHEREAS, the City Council set the date �f Ja„nary 3, 2000, for
a public hearing on this request; and
WHEREAS, at least ten (10) days notice of the time and place
of this hearing was published in a newspaper of general circulation
in the City; and
WHEREAS, a public hearing was held on January 3, 2000, at
which all interested parties were afforded the opportunity to speak
in favor of or in opposition to the proposed sewer, utility and
drainage easement vacation; and
WHEREAS, the City Council has determined that the sewer,
utility and drainage easement in question is not necessary or
needed for the purposes for which it was dedicated and established;
and
WHEREAS, it is in the public interest that the sewer, utility
and drainage easement be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City's interest in a sewer, utility and
drainage easement on the following described real estate:
Commence at the Northwest corner of Lot 14 of Cape West
Third Subdivision as recorded in Plat Book 16 at Page 82;
thence North 62049106” East, 15.0 feet to the True Point
of Beginning; thence continue North 62049106" East,
370.0 feet to the Northeast corner of said Lot 14; thence
South 27010154" East, 15.0 feet along the East line of
said Lot 14; thence South 62049106" West, 370.0 feet to
a point on the East line of an existing 15 -foot wide
sewer, utility, and drainage easement; thence North
27°10154" West, 15.0 feet to the Point of Beginning.

is hereby vacated.
ARTICLE 2. This ordinance shall be in full force and effect
ten days after its passage and approval.

acknowledged said instrument to be the free act and deed of said
City.
