AN ORDINANCE ACCEPTING SEWER EASEMENTS FROM
JEWEL MAE HABECK AND FIRST ASSEMBLY OF GOD
CHURCH, FOR A SANITARY SEWER EXTENSION ALONG
HOPPER ROAD FROM OAK RIDGE COURT TO DEARMORE
COURT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Sewer Easement, executed by Jewel Mae Habeck, conveying
to the City of Cape Girardeau, Missouri, a Sewer Easement for an
eight inch sanitary sewer extension along Hopper Road from Oak
Ridge Court to just west of Dearmore Court, more particularly
described as follows, to -wit:
A part of the Northeast Quarter of Section 34, Township
31 North, Range 13 East of the Fifth Principal
Meridian, City and County of Cape Girardeau, State of
Missouri, being more particularly described as follows:
A strip of land being the north 34.00 feet of a tract
of land as recorded in the land records of the County
Recorder's Office in Book No. 453 at Page No. 001 and
shown on the Right of Way Taking Plat for the Hopper
Road Improvements on file at the City Engineers Office
of the City of Cape Girardeau, Missouri.
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby
accepts a Sewer Easement, executed by First Assembly of God
Church, a not-for-profit corporation, conveying to the City of
Cape Girardeau, Missouri, a Sewer Easement for an eight inch
sanitary sewer extension along Hopper Road from Oak Ridge Court
to just west of Dearmore Court, more particularly described as
follows, to -wit:
A PART OF THE NORTHEAST QUARTER OF SECTION 34, TOWNSHIP
31 NORTH, RANGE 13 EAST OF THE FIFTH PRINCIPAL
MERIDIAN, CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF
MISSOURI, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
Commencing at an iron railroad spike at the northeast
corner of Section 34, said point being the centerline
intersection of Hopper and Kage Roads, Thence along the
north line of said section 34, S 89034133" W, 525.82
feet to the TRUE POINT OF BEGINNING;
Thence leaving said north line, S 00000100" W 26.11
feet; Thence S 90000100" E, 338.00 feet; Thence S

00°00100" W, 7.00 feet; Thence N 90000100" W, 365.14
feet to the beginning of a curve concave to the
southeast, having a central angle of 00035148" and a
radius of, 9963.00 feet; Thence along said curve in a
southwesterly direction, 103.76 feet to a point on the
west line of a tract of land as recorded in the land
records of the County Recorder's Office in book no. 967
at page no. 959 and shown on the Right of Way Taking
Plat for the Hopper Road Improvements on file at the
City Engineer's Office of the City of Cape Girardeau;
Thence along said west line, N O10 06138" E, 32.69 feet
to a point on the north line of said section 34; Thence
along said north line, N 89034133" E, 130.27 feet to
the point of beginning, containing 0.15 acres more or
less.
ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
