AN ORDINANCE AMENDING THE BOUNDARIES OF
LATERAL SEWER DISTRICT NO. 14-J, A SUBDIVISION
OF TRUNK SEWER DISTRICT NO. 14, APPROVING THE
PLANS AND AUTHORIZING THE CONSTRUCTION OF A
SYSTEM OF SANITARY LATERAL SEWERS IN LATERAL
SEWER DISTRICT NO. 14-J, UNDER A PRIVATE
CONTRACT SUBJECT TO CERTAIN PROVISIONS, IN
THE CITY OF CAPE GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The boundaries of Lateral Sewer District No. 14-J,
a subdivision of Trunk Sewer District No. 14, as established in
Ordinance No. 786, passed and adopted June 6, 1973, are hereby
amended to read as follows:
Amendment of Sewer District 14-J
For the Chateau Girardeau Expansion Project
Commence at the northeast corner of Lot 9 of Auburn Park
Subdivision; thence South 8015' West, along the east
line of Outlot No. 83 and said Lot 9 of Auburn Park
Subdivision, 240.1 feet to the southeast corner of Lot 10
of Auburn Park Subdivision and the northeast corner of a
tract of land as recorded in Book 326 at Page 962 of the
land records of Cape Girardeau County, Missouri; thence
continue along the east line of Outlot No. 83,
approximately 290 feet to a point; thence Westerly,
parallel to and approximately 650 feet north measured
normal to the north right of way line of Independence
Street, to the east right of way line of Mount Auburn
Road; thence Northerly with said east right of way of
Mount Auburn Road, approximately 290 feet to the
southwest corner of Lot 18 of Auburn Park Subdivision;
thence North 600' East, along the east right of way line
of Mount Auburn Road, 240 feet to the northwest corner of
Lot 1 of Auburn Park Subdivision; thence South 83009'
East, 1793.5 feet to the Point of Beginning.
ARTICLE 2. That the plans for the construction of a system of
sanitary lateral sewers to serve Lateral Sewer District No. 14-J,
a copy of which is on file in the office of the City Clerk, have
heretofore been approved and ordered filed.
ARTICLE 3. That the owners of lands in said Lateral Sewer
District No. 14-J are hereby granted permission to construct said
system of sanitary lateral sewers in Lateral Sewer District No. 14-
J and to connect same to existing sewers in Trunk Sewer District
No. 14, subject to the following provisions.
1. That proper authority will be secured to proceed from the
Missouri Clean Water Commission.
2. That all permanent easements for said sewers on private
property are made to the City of Cape Girardeau,
Missouri, prior to execution of a contract for the work
of construction of said sewers.
3. That all City Ordinances, Standard Specifications of the
City and State laws applicable to this project will be
observed in all respects.
4. That the quality of the work and materials be inspected
by the agents of the City Engineer of the said City, and
that cost of said inspections be paid to said City
following the completion of the work.
ARTICLE 4. This ordinance shall be in full force and effect
ten days after its passage and approval.
