AN ORDINANCE ACCEPTING PERMANENT AND
TEMPORARY CONSTRUCTION EASEMENTS FROM OPAL
LINCOLN FOR THE SANITARY SEWER IMPROVEMENT
PROGRAM PHASE II SLOAN CREEK RELIEF SEWER
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby accepts a
Permanent Easement executed by Opal Lincoln on property located at 1136 N.
Fountain Street in the City and County of Cape Girardeau, State of Missouri, more
particularly described as follows, to -wit:
That part of Lot 18 in Block 1 of Marble City Heights, a subdivision
recorded in Plat Book 2 at Page 36 in the Land Records of Cape
Girardeau County, and that part of Ruby Street, now vacated, all in
the City and County of Cape Girardeau, State of Missouri, more
particularly described as follows:
Commence at the Southeast corner of Lot 17 in Block 1 of said
subdivision; thence with the East lines of said Lots 17 and 18, North
06'35'14" East, 78.76 feet, to the point of beginning; thence leaving
said East line, North 51°51'15" West, 43.96 feet, to a point on the
North side of vacated Ruby Street; thence with said North side, South
82°46'36" East 29.19 feet; thence leaving said North side, South
51 °51 '15" East, 9.70 feet; thence with the East line of said Lot 18,
South 06'35'14" West, 17.60 feet, to the point of beginning and
containing 402 square feet, more or less.
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby accepts a
Temporary Construction Easement executed by Opal Lincoln on property located at
1 136 N. Fountain Street in the City and County of Cape Girardeau, State of Missouri,
more particularly described as follows, to -wit:
That part of Lot 18 in Block 1 of Marble City Heights, a subdivision
recorded in Plat Book 2 at Page 36 in the Land Records of Cape
Girardeau County, and that part of Ruby Street, now vacated, all in
the City and County of Cape Girardeau, State of Missouri, more
particularly described as follows:
Commence at the Southeast corner of Lot 17 in Block 1 of said
subdivision; thence with the East lines of said Lots 17 and 18, North
06035'14" East, 61.16 feet, to the point of beginning; thence leaving
said East line, North 51°51'15" West, 78.21 feet, to a point on the
North side of vacated Ruby Street; thence with said North side, South
82046'36" East 66.65 feet; thence with the East lines of said Lots,
South 06035'14" West, 40.19 feet, to the point of beginning and
containing 1339 square feet, more or less.
ARTICLE 3. This ordinance shall be in full force and effect ten days after its
passage and approval.
