AN ORDINANCE ACCEPTING WATER UTILITY
EASEMENTS FROM ORSCHELN FARM AND HOME L.L.C.
AND MICHAEL J. KUTZ AND MARY D. KUTZ
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby accepts a Water
Utility Easement executed by Orscheln Farm and Home L.L.C. on property located on
the north side of Bloomfield Road between Christine Street and Plaza Way,
commonly known as 338 Christine Street in the City and County of Cape Girardeau,
State of Missouri, more particularly described as follows, to -wit:
All that part of Out Lot 87 in the City and County of Cape Girardeau,
State of Missouri, more particularly described as follows:
Beginning at the Intersection of the north right-of-way line of
Bloomfield Road and the west right-of-way line of Plaza Way Street;
thence along the west right-of-way line of Plaza Way Street, North
06044'00" East, 72.40 feet; thence North 84°28'00" West, 10.00
feet; thence South 06°44'00" West, 76.87 feet, more or less, to a
point in the north right-of-way line of Bloomfield Road; thence along
said north right-of-way line of Bloomfield Road, North 71'39'14" East,
11 .04 feet, more or less, to the point of beginning and containing 746
square feet, more or less.
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby accepts a Water
Utility Easement executed by Michael J. Kutz and Mary D. Kutz on property located
on the west side of Plaza Way north of Bloomfield Road in the City and County of
Cape Girardeau, State of Missouri, more particularly described as follows, to -wit:
The East 10 feet of that part of Out Lot 56 in the City and County of
Cape Girardeau, State of Missouri, more particularly described as
follows:
Commence at the intersection of the West line of Out Lot 56 and the
North line of Bloomfield Road; thence North 06°44'00" East, along said
West line of Out Lot 56, 140.00 feet, to the place of beginning; thence
continue North 06044'00" East 125.00 feet; thence South 83°16'00"
East, 120.00 feet, to a point on the West line of Plaza Way; thence
with said West line, South 06°44'00" West, 125.00 feet; thence North
83°16'00" West, 120.00 feet, to the place of beginning and containing
15,000 square feet, more or less.
ARTICLE 3. This ordinance shall be in full force and effect ten days after its
passage and approval.
