AN ORDINANCE ACCEPTING A GENERAL WARRANTY DEED FROM
CAPE GIRARDEAU SAND COMPANY, INC. FOR THE CAPE ROCK
WATER TREATMENT PLANT EXPANSION PROJECT – ALLUVIAL WELL
FIELD
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby accepts a General
Warranty Deed executed by the Cape Girardeau Sand Company, Inc., conveying to
the City of Cape Girardeau, Missouri, a General Warranty Deed for development of an
alluvial well field as part of expansion and improvements to the Cape Rock Water
Treatment Plant, more particularly described as follows, to -wit:
All of that part of USP Surveys No. 2199 and 3091, Township 31
North, Range 14 East of the Fifth Principal Meridian, in the City and
County of Cape Girardeau, State of Missouri, more particularly described
as follows:
Commence at the most Southerly corner of Lot No. 6, Block I, of Cape
Rock Hills Subdivision, as recorded in Plat Book 3, at Page 29, in the
office of the Recorder of Deeds in said Cape Girardeau County, thence
South 33'08'12" East, 255.46 feet, to a point on the Easterly right-of-
way line of the Burlington Northern Railroad (formerly St. Louis and San
Francisco Railroad), for the place of beginning; thence with said
Easterly right-of-way line, North 72°28'08" East, 338.68 feet, to the
point of curvature of a curve to the left, said curve having a radius of
2088.57 feet; thence along the arc of said curve a distance of 289.45
feet, to the point of a compound curve having a radius of 1543.39 feet;
thence along the arc of said curve a distance of 182.20 feet, to the
intersection of the Easterly right-of-way line of said railroad and the
Westerly low water line of the Mississippi River; thence with the said
Westerly low water line, South 05°29'40" West, 61.58 feet; thence
South 31'09'09" West, 237.37 feet; thence South 49°08'55" West,
144.05 feet; thence South 43°27'46" West, 417.97 feet; thence
South 47'42'41" West, 386.58 feet; thence South 47°24'08" West,
536.31 feet; thence South 50°32'28" West, 1269.24 feet; thence
South 49°13'39" West, 1030.86 feet; thence leaving said Westerly
low water line, North 45°55'38" West, 701.83 feet, to a point of the
Easterly right-of-way line of the Burlington Northern Railroad; thence
with said line, North 44°04'22" East, 755.07 feet, to a point of
curvature of a curve to the right having a radius of 3767.22 feet;
thence along the arc of said curve a distance of 785.08 feet; thence
North 56°00'47" East, 1046.54 feet, to the point of curvature of a
curve to the right having a radius of 2814.82 feet; thence along the arc
of said curve a distance of 808.45 feet, to the place of beginning and
containing 57.05 acres, more or less.
Note a: The right-of-way for the Burlington Northern Railroad was
determined by splitting the existing rails and offsetting the right-of-way
distance each side of centerline.
Note b: The Westerly low water line of the Mississippi River is a
Riparian Boundary and is subject to constant change with the movement
of the river. The actual line is defined by State Statute as the low water
mark and which is herein represented as an approximation of said mark
on the date of survey.
ARTICLE 2. This ordinance shall be in full force and effect ten days after its
passage and approval.
