AN ORDINANCE ACCEPTING A PERMANENT SEWER
EASEMENT FROM J. B. PROPERTIES, INC., FOR
SANITARY SEWER IMPROVEMENTS IN HILLCREST
PLACE SUBDIVISION
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Permanent Sewer Easement, executed by J. B. Properties,
Inc., by Ronn Unterreiner, President, conveying to the City of
Cape Girardeau, Missouri, a Permanent Sewer Easement for sanitary
sewer improvements to serve Hillcrest Place Subdivision, Sewer
District 10, described as follows, to -wit:
THAT PART OF LOTS NO. 1, 2, AND 3 OF HILLCREST PLACE SUBDIVISION,
A SUBDIVISION ON FILE IN THE LAND RECORDS OF CAPE GIRARDEAU
COUNTY, IN THE CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF
MISSOURI, MORE PARTICULARLY DESCRIBED AS FOLLOWS:
Commence at the Southeast corner of said Lot No. 1; thence with
the east line of said Lot No. 1, North 20047'07" East, 77.94 feet;
thence along the arc of a curve to the left, having a radius of
782.17 feet, a distance of 62.32 feet (the chord of said arc bears
North 18030'10" East, 62.30 feet), to the point of beginning;
thence leaving said east line, North 46032'05" West, 373.20 feet;
thence North 13039'07" East, 17.29 feet, to a point on the North
line of said Lot No. 3; thence with the north line of said Lot No.
3, and said Lot No. 2, and said Lot No. 2 extended, South
46°32'05" East, 373.87 feet, to the east line of said Lot No. 1;
thence with said east line, along the arc of a non -tangent curve
concave to the west, having a radius of 782.17 feet, a distance of
16.97 feet (the chord of said arc bears South 15035'55" West,
16.97 feet), to the point of beginning and containing 5,604 square
feet (0.13 acres)
ARTICLE 2. This ordinance shall be in full force and effect
ten days after its passage and approval.
