AN ORDINANCE ESTABLISHING THE BOUNDARIES OF
LATERAL SEWER DISTRICT NO. 16-E, A SUBDIVISION
OF TRUNK SEWER DISTRICT NO. 16, APPROVING THE
PLANS AND AUTHORIZING THE CONSTRUCTION OF A
SYSTEM OF SANITARY LATERAL SEWERS IN LATERAL
SEWER DISTRICT NO. 16-E, UNDER A PRIVATE
CONTRACT SUBJECT TO CERTAIN PROVISIONS, IN
THE CITY OF CAPE GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. That the boundaries of Lateral Sewer District No.
16-E, a subdivision of Trunk Sewer District No. 16 in the City of
Cape Girardeau, Missouri, shall be as follows:
The boundaries of Lateral Sewer District No. 16-E, a
subdivision of Trunk Lateral District No. 16, in the City of Cape
Girardeau, shall be as follows:
Commence at a Z" iron pin being a common corner to
U.S.P.S. 175, U.S.P.S. 679, and a tract of land as
recorded in the land records of the County Recorder's
Office in book no. 381 at page no. 892; thence along the
south line of U.S.P.S. 175 and the north line of afore
said tract of land, North 840 02' 48" West, 787.35 feet
to a point on the south right of way line of Bloomfield
Road; thence leaving the afore said line and along said
right of way line, North 38° 53' 30" East, 8.40 feet to
the beginning of a curve concave to the northwest having
as a central angle of 080 06' 49" and a radius of 830.00
feet; thence along said curve in a northeasterly
direction, 117.54 feet; thence North 300 46' 41" East,
164.64 feet to the beginning of a curve concave to the
southeast having a central angle of 250 06' 42" and a
radius of 770.00 feet; thence along said curve in a
northeasterly direction, 337.48 feet; thence North 550
53' 23" East, 558.85 feet; thence North 590 45' 14" East,
350.57 feet to a point on the westerly right of way of
Siemers Drive; thence along said right of way, South 560
17' 57" East, 108.46 feet; thence South 330 31' 00" East,
25.20 feet to the beginning a curve concave to the
southwest having a central angle of 260 34' 44" and a
radius of 1392.39 feet; thence along said curve in a
southeasterly direction 645.92 feet; thence South 060 56'
16" East, 361.25 feet to the beginning of a curve concave
to the northeast having a central angle of 23° 16' 12"
and a radius of 1000.43 feet; thence along said curve in
a southeasterly direction, 406.31 feet to a point on the
northerly right of way of Missouri State Route 74; thence
leaving the afore said westerly right of way and along
said northerly right of way, South 47° 45' 55" West,
30.17 feet; thence South 510 30' 58" West, 75.00 feet;
thence South 380 29' 02" East, 54.44 feet to a point on
the north line of the afore said tract of land recorded
in book no. 381 at page no. 892 said point being also on
the southerly line of U.S.P.S. 175; thence leaving the
afore said right of way line and along the southerly
lines of U.S.P.S. 175, North 840 00' 00" West, 858.78
feet, thence North 050 11' 25" East, 384.81 feet to the
Point of Beginning, containing 31.35 acres more or less.
ARTICLE 2. That the plans for the construction of a system of
sanitary lateral sewers to serve Lateral Sewer District No. 16-E,
a copy of which is on file in the office of the City Clerk, have
heretofore been approved and ordered filed.
ARTICLE 3. That the owners of lands in said Lateral Sewer
District No. 16-E are hereby granted permission to construct said
system of sanitary lateral sewers in Lateral Sewer District No.
16-E and to connect same to existing sewers in Trunk Sewer District
No. 16, subject to the following provisions.
1. That proper authority will be secured to proceed from the
Missouri Clean Water Commission.
2. That all permanent easements for said sewers on private
property are made to the City of Cape Girardeau,
Missouri, prior to execution of a contract for the work
of construction of said sewers.
3. That all City Ordinances, Standard Specifications of the
City and State laws applicable to this project will be
observed in all respects.
4. That the quality of the work and materials be inspected
by the agents of the City engineer of the said City, and
that cost of said inspections be paid to said City
following the completion of the work.

ARTICLE 4. This ordinance shall be in full force and effect
ten days after its passage and appr?val.
