AN ORDINANCE VACATING THE CITY'S INTEREST IN A
UTILITY EASEMENT AT 2723-2725 THEMIS STREET,
IN THE CITY OF CAPE GIRARDEAU, MISSOURI
WHEREAS, the City Council has received a request that the City
vacate a utility easement at 2723-2725 Themis Street, and more
particularly described in Section 1 hereof; and
WHEREAS, the City Council set the date of June 7, 1999, for a
public hearing on this request; and
WHEREAS, at least ten (10) days notice of the time and place
of this hearing was published in a newspaper of general circulation
in the City; and
WHEREAS, a public hearing was held on June 7, 1999 at which
all interested parties were afforded the opportunity to speak in
favor of or in opposition to the proposed utility easement
vacation; and
WHEREAS, the City Council has determined that the utility
easement in question is not necessary or needed for the purposes
for which it was dedicated and established; and
WHEREAS, it is in the public interest that the utility
easement be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City's interest in a utility easement on the
following described real estate:
That part of Lots 1 and 2 of Block 6 of Crites Third
Addition in the City and County of Cape Girardeau,
Missouri described as follows:
Commence at the Southeast Corner of Crites Third
Addition; thence North 8809' West, 465.00 feet to the
Point of Beginning; thence continue North 8809' West,
10.00 feet; thence North 0151' East, 100.00 feet to a
point on the South Line of Themis Street; thence along
said South Line South 8809' East, 10.00 feet; thence
South 0151' West, 100.00 feet to the Point of Beginning.
is hereby vacated.

ARTICLE 2. This ordinance shall be in full force and effect
ten days after its passage and approval
