AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF PART OF
THE 1800 BLOCK OF NORTH KINGSHIGHWAY, CITY
AND COUNTY OF CAPE GIRARDEAU, MISSOURI FROM
C-2 AND R-1 TO C-2
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 1 of
this ordinance should be rezoned from C-2, General Commercial
District and R-1, Single -Family Dwelling District to C-2, General
Commercial District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City of
Cape Girardeau, Missouri, and public hearing was held on Monday,
June 7, 1999; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 from C-2, General Commercial District and R-1, Single -
Family Dwelling District to C-2, General Commercial District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, is hereby amended to change the
zoning from the present C-2, General Commercial District and R-1,
Single -Family Dwelling District to C-2, General Commercial
District, for the following described property:
That part of the East Half of the Northwest Quarter and
the West Half of the Northeast Quarter of Section 26,
Township 31 North, Range 13 East of the Fifth Principal
Meridian, described as follows: Commence at the
Northwest corner of said East Half of the Northwest
Quarter; thence Easterly along the Section Line, 802.5
feet to a 1/2 inch iron rod; thence South 1 deg. 05
min. 58 sec. East, 955.19 feet for a place of
beginning, thence North 67 deg. 28 min. 18 sec. East,
784.94 feet; thence South 2 deg. 37 min. 30 sec. West
1062.21 feet to a 1/2 inch iron rod on the North
right-of-way line of U. S. Route 61; thence North 56
deg. 03 min. 28 sec. West along said right-of-way,
16.45 feet to a right-of-way marker 64 feet opposite
and mean to Highway Station 994 plus 00; thence North
51 deg. 29 min. 02 sec. West along said right-of-way,
200.64 feet to a right-of-way marker 80 feet opposite
and mean to Highway station 992 plus 00; thence North
56 deg. 03 min. 28 sec. West along said right-of-way,
499.41 feet to an angle point in said right-of-way, 80
feet opposite and mean to Highway Station 987 plus 00
ahead and 986 plus 85.7 back; thence North 61 deg. 54
min. 33 sec. West along said right-of-way, 85.69 feet
to a concrete right-of-way monument 70 feet opposite
and mean to Highway Station 986 plus 00; thence North
55 deg. 12 min. 28 sec. West along said right-of-way
being 70 feet North of centerline, 12.26 feet to 1/2
inch iron rod; thence departing from said right-of-way
North 1 deg. 05 min. 58 see. West, 300.00 feet to the
place of beginning, in the City of Cape Girardeau, Cape
Girardeau County, Missouri, containing 10.766 acres.
ARTICLE 2. The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present time
particularly suitable for the purposes and uses of C-2, General
Commercial District, and that such changes authorized hereby are
reasonable and in reasonable conformity with the existing uses
and value of the immediately surrounding properties.
ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
