AN ORDINANCE ACCEPTING A QUIT CLAIM DEED FROM
THE BOARD OF REGENTS OF SOUTHEAST MISSOURI
STATE UNIVERSITY FOR HENDERSON AND NEW MADRID
INTERSECTION RIGHT-OF-WAY
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Quit Claim Deed, executed by the Board of Regents of
Southeast Missouri State University, a State Educational
Institution, conveying to the City of Cape Girardeau, Missouri, a
Quit Claim Deed for Henderson and New Madrid intersection right-
of-way, more particularly described as follows, to -wit:
Part of Outlot No. 72 in U. S. Private Survey 2199 in the City and
County of Cape Girardeau, Missouri, more particularly described as
follows:
TRACT "A": Commencing at the Southeast corner of Outlot No. 72;
thence North 04° 05' 59" West, 554.98 feet to the point of
beginning, said point of beginning being on the West right of way
of N. Sprigg Street; thence North 83° 16' 00" West, 274.63 feet to
a point; thence North 850 10' 33" West, 837.23 feet to a point;
thence North 040 49' 27" East, 10.00 feet to a point in a curve to
the left; thence along said curve to the left, having a radius of
545.00 feet for a length of 454.62 feet to a point; thence South
48° 51' 59" West, 71.37 feet to a point in a curve to the left;
thence along said curve to the left, having a radius of 370.00
feet for a length of 194.00 feet to a point; thence South 180 49'
28" West, 226.22 feet; thence South 000 47' 46" East, 47.44 feet
to a point; thence South 890 20' 57" West 182.21 feet to a point;
thence North 390 6' 30" East, 17.97 feet to a point; thence North
84° 1' 41 " East, 123.98 feet to a point; thence North 00 17' 9"
East, 72.09 feet to a point; thence North 180 49' 28" East, 194.45
feet to a point in a curve to the right; thence along said curve
to the right, having a radius of 430.00 feet for a length of
225.46 feet to a point; thence North 480 51' 59" East, 71.37 feet
to a point in a curve to the right; thence along said curve to the
right, having a radius of 605.00 feet for a length of 502.71 feet
to a point; thence North 040 49' 27" East, 10.00 feet to a point;
thence South 850 10' 33" East, 838.23 feet to a point; thence
South 830 16' 00" East, 266.66 feet to a point on the West right
of way of North Sprigg Street; thence along said N. Sprigg Street
right of way, South 000 08' 15" East, 80.52 feet to the point of
beginning. Containing 152,707 square feet (3.50 acres), more or
less.
Part of Outlot No. 37 in U. S. Private Survey 2199 in the City and
County of Cape Girardeau, Missouri, more particularly described as
follows:
TRACT "B": Commencing at the Northeast corner of Outlot No. 37;
thence South 890 20' 57" West along said Outlot line, 635.00 feet
to the East line of Henderson Avenue extended; thence South 00°
26' 03" East along said East line, 18.0 feet to the point of
beginning; thence North 89° 20' 57" East, 24.85 feet to a point in
a curve to the left having a radius of 85.0 feet for a length of
66.69 feet to a point; thence North 00" 26' 03" West, 59.96 feet
to the point of beginning. Containing 463 square feet (more or
less).
Part of Outlot No. 37 in U. S. Private Survey 2199 in the City and
County of Cape Girardeau, Missouri, more particularly described as
follows:
TRACT "C": Commencing at the Northwest corner of Outlot No. 37;
thence North 890 37' 09" East, 488.00 feet to the Northwest corner
of Lot 1, Block 14, Normal Heights Subdivision, also known as the
point of beginning; thence continue North 89° 37' 09" East along
said Outlot line, 110.20 feet to a point; thence South 400 28' 22"
East, 23.01 feet to a point; thence South 0° 26' 3" East, 50.08
feet to a point; thence South 89° 33' 57" West, 125.00 feet to a
point; thence North 00 26' 3" West, 67.80 feet to the point of
beginning. Containing 8,337 square feet (more or less).
THE AUTHORITY FOR THIS TRANSACTION WAS GRANTED PURSUANT TO SENATE
BILL NO. 695 OF THE 89TH GENERAL ASSEMBLY.
ARTICLE 2. This ordinance shall be in full force and effect
ten days after its passage and approval.
