AN ORDINANCE VACATING THE CITY'S INTEREST IN A
SANITARY SEWER MAIN EASEMENT AT 1105 WEST
MOUNT DRIVE, IN THE CITY OF CAPE GIRARDEAU,
MISSOURI
WHEREAS, the City Council has received a request that the City
vacate a sanitary sewer main easement at 1105 West Mount Drive, and
more particularly described in Section 1 hereof; and
WHEREAS, the City Council set the date of May 17, 1999, for a
public hearing on this request; and
WHEREAS, at least ten (10) days notice of the time and place
of this hearing was published in a newspaper of general circulation
in the City; and
WHEREAS, a public hearing was held on May 17, 1999 at which
all interested parties were afforded the opportunity to speak in
favor of or in opposition to the proposed sanitary sewer main
easement vacation; and
WHEREAS, the City Council has determined that the sanitary
sewer main easement in question is not necessary or needed for the
purposes for which it was dedicated and established; and
WHEREAS, it is in the public interest that the sanitary sewer
main easement be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City's interest in a sanitary sewer main
easement on the following described real estate:
A PART OF LOT 3, BLOCK 1 OF KIRCHHOFF'S SUBDIVISION IN
THE CITY AND COUNTY OF CAPE GIRARDEAU, MISSOURI, MORE
PARTICULARLY DESCRIBED AS FOLLOWS:
THIS EASEMENT WIDTH IS FIVE FEET BOTH SIDES OF THE
FOLLOWING DESCRIBED CENTERLINE:
BEGIN AT THE SOUTHEAST CORNER OF LOT 3, BLOCK 1,
KIRCHHOFF'S SUBDIVISION FOR A POINT BEGINNING, THENCE,
NORTH 45 DEGREES, ZERO MINUTES, ZERO SECONDS WEST FOR A
DISTANCE OF 132.5 FEET TO A POINT ON THE NORTH LINE OF
SAID LOT 3 AND THERE TERMINATING.
is hereby vacated.
ARTICLE 2. This ordinance shall be;'full force and effect
ten days after its passage and approval./

said City and that the said instrument was signed and sealed in
behalf of said City by authority of its City Council and
acknowledged said instrument to be the free act and deed of said
City.
