AN ORDINANCE AMENDING CHAPTER 30 OF THE CITY
CODE RELATING TO ZONING
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. Section 30-2 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, entitled "Definitions", is
hereby amended by adding new definitions, in words and figures to
read as follows:
Section 30-2. Definitions.
Microbrewery means a business whose primary
activity is the brewing and selling of beer, with an
annual production of ten thousand (10,000) barrels or
less (one barrel of beer yields two common 15 z gallon
kegs).
Pub brewery means a bar, tavern, pub, or
restaurant -bar wherein beer is brewed on the premises
in a microbrewery for sale either on or off the
premises.
ARTICLE 2. Section 30-39(d) of the Code of Ordinances of
the City of Cape Girardeau, Missouri, entitled "Special Uses", is
hereby amended by addition thereto a new use, in words and
figures, to read as follows:
Sec. 30-39. Special Use Regulations.
(d) Special uses.
(39) Microbrewery or pub brewery in a "C-211, 11C-
311, or 11M-1 district.
ARTICLE 3. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the
validity of the remaining portions hereof.
ARTICLE 4. It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and the sections of this Code may be
renumbered to accomplish such intention.
ARTICLE 5. This ordinance shall be in full force and effect
ten days after its passage and approval.
