AN ORDINANCE DETACHING FROM THE
CITY OF CAPE GIRARDEAU, MISSOURI
CERTAIN LAND ABUTTING THE CITY OF
JACKSON, MISSOURI
WHEREAS, there is an uninhabited tract of land that lies on the west side of
Interstate 55, adjacent to the current Jackson City boundary, that is within the City of Cape
Girardeau; and
WHEREAS, it would be in the best interest of the City of Cape Girardeau and the
City of Jackson to detach this tract from the City of Cape Girardeau and to annex same into
the City of Jackson in order that the boundary lines of both cities will be made more
uniform;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. That the corporate limits of the City of Cape Girardeau, Missouri,
shall be contracted so as to detach the following described unincorporated area of land as
described hereinbelow, to -wit:
Part of the Right of Way of Interstate Highway 55 which lies in Section 21 and 22,
Township 31 North, Range 13 East of the Fifth Principal Meridian, City of Cape
Girardeau Missouri, and being more particularly described as follows:
Commencing as a point of reference on the east right of way line of Interstate
Highway 55, said point being at right angles to Station 1021+67 on the centerline
median of said highway, said point being the most northern corner of the corporate
limits of the City of Cape Girardeau, Missouri on said right of way line as described
in City Manager form Ordinance No. 176, approved on the 6`" day of September
1967; thence along said right of way line north 33° 03' 36" west 731.20 feet; thence
north 21' 45' 00" west 1082.00 feet; thence leaving said east right of way line north
87° 51' 00" west 278.92 feet to a point in the west right of way line 125 feet right of
Station 1002+55; thence along said west right of way line south 21° 45' 00" east
545.00 feet; thence south 14° 26' 06" east 935.41 feet; thence south 09° 50' 34" east
749.30 feet to the true point of beginning of tract herein described; thence along
said right of way line south 34° 00' 53" east 700.00 feet; thence south 22° 35' 33"
east 340.04 feet; thence north 85° 59' 41" east 26.25 feet; thence south 21' 45' 00"
east 747.00 feet; thence south 36° 49' 07" east 269.26 feet; thence leaving said right
of way line north 21' 45' 00" west 1224.52 feet; thence north 34° 00' 53" west
798.82 feet; thence north 88° 30' 53" west 85.98 feet to the point of beginning and
containing 3.24 acres.

ARTICLE 2. This ordinance shall take effect and be in force from and after ten days
after its final passage and approval.
ARTICLE 3. If any section, subsection, sentence, clause, phrase or portion of this
ordinance is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining portions hereof.
ARTICLE 4. That the City Clerk is authorized and directed to cause three (3)
certified copies of this ordinance in its final form to be filed with the Clerk of Cape
Girardeau County as provided by Section 71.012 RSMo.
ARTICLE 5. That the City Council of Cape Girardeau, Missouri, does hereby find
and determine that the detachment of the tract of land is reasonable and necessary to the
proper development of the City, and is in the best interest of the City of Cape Girardeau,
Missouri.
