AN ORDINANCE DECLARING IT NECESSARY TO IMPROVE
THAT PART OF HOPPER ROAD FROM OAK RIDGE COURT
TO I-55, FOR A DISTANCE OF APPROXIMATELY 1700
FEET, IN THE CITY OF CAPE GIRARDEAU,
MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. That the Council of the City of Cape Girardeau,
Missouri, hereby declares it necessary to improve Hopper Road from Oak
Ridge Court to I-55, for a distance of approximately 1700 feet, in the
City of Cape Girardeau, Missouri, by grading to the established grade
and constructing thereon a Portland Cement Concrete Pavement seven (7)
inches thick and thirty-six (36) feet in width between the back of
upright curbs, and storm sewers and other necessary appurtenances,
which shall be constructed as shown on the plans and specifications for
said improvement which have been filed with the City Clerk. It is the
intention of the City Council to have this project done by contract and
to tax bill the costs against the abutting properties.
ARTICLE 2. That this ordinance be published for seven consecutive
insertions in the Southeast Missourian, a daily newspaper, printed and
published in the City of Cape Girardeau, Missouri, and if a majority of
the resident owners of the lands that would be liable for the costs of
the improvements, at the date of the passage of this ordinance, who
shall own a majority of the front feet owned by the residents of the
City, abutting on the part of said Hopper Road proposed to be improved,
shall not within ten days after the last publication of the ordinance,
file with the City Clerk their protest against such improvements, then
the City Council shall have the power to cause the improvements to be
made and assess the costs against the property abutting on the
improvements as provided by law.
ARTICLE 3. A public hearing will be held before the City Council
at 7:30 P.M. on Monday, February 1, 1999, at City Hall, 401
Independence, Cape Girardeau, Missouri, at which citizens and all
interested parties may be heard on the question of the necessity of the
work sought to be done.
ARTICLE 4. This ordinance shall be in full force and effect ten
days after its passage and approval.
