A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE A RELEASE OF LIEN ON PROPERTY LOCATED
AT 213 SOUTH LORIMIER STREET, FOR THE HOME
REPAIR OPPORTUNITY GRANT (HeRO) PROGRAM
WHEREAS, the City of Cape Girardeau previously entered into
an Agreement dated December 3, 2008, with Gavin Thomas and
Victoria Thomas for the grant of funds to make repairs to property
located at 213 South Lorimier Street and described as follows:
That part of Lot Twenty -Six (26) in Range "G" in the City of
Cape Girardeau, Missouri, and described as follows: Begin at
the northeast corner of said Lot 26; thence run West, 100
feet; thence run South 40 feet; thence East 100 feet; thence
North 40 feet to the point of beginning, being the same
property conveyed by Pauline A. Fassel and others to Lulu L.
Holschen and Albert Holschen, by deed dated October 6, 1938,
recorded in Book 107 at page 429 of the land records of Cape
Girardeau County, in the Recorder's Office at Jackson,
Missouri to which reference is had see also Deed Book 77 at
page 169 of same records for title deed.
ALSO part of Lot No. Twenty -Six (26) in Range "G" in the City
and County of Cape Girardeau, Missouri, described as follows:
From the northeast corner of said Lot No. 26 run West with
the north line of said lot, 100 feet for a beginning point;
continue West along said north line of said lot, 80 feet to
an alley; thence South with the east line of said alley, 40
feet; thence East parallel with William Street, 80 feet; and
thence North parallel with the west line of Lorimier Street,
40 feet to the place of beginning.
all pursuant to the Home Repair Opportunity Grant (HeRO) Program;
and
WHEREAS, that grant agreement was recorded in the land
records of Cape Girardeau County in Document Number 2009-00182,
and Gavin Thomas and Victoria Thomas have fulfilled the terms of
the program; and
WHEREAS, it is the desire of the City of Cape Girardeau,
Missouri, to release the lien created by the Agreement dated
December 3, 2008.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Manager is authorized to execute a
Release of Lien and to cause said Release to be recorded in the
land records of Cape Girardeau County, Missouri, so that the above
described property may be free of any lien or claim by the City of
Cape Girardeau, Missouri, by reason of the Agreement dated
December 3, 2008, and recorded in Document Number 2009-00182 of
the land records of Cape Girardeau County, Missouri.
