A RESOLUTION ACKNOWLEDGING RECEIPT OF AN
ANNEXATION PETITION FROM FRUITLAND LIVESTOCK
MARKET, INC. AND SETTING A PUBLIC HEARING
REGARDING THE PROPOSED ANNEXATION
WHEREAS, a Petition for annexation has been presented to the City Council of Cape Girardeau,
Missouri, requesting that certain property be annexed into the City of Cape Girardeau, Missouri; and
WHEREAS, the Petition has been presented in accordance with Chapter 71.012 Revised Statutes
of Missouri, which statute provides for voluntary annexation upon request of the affected property
owners; and
WHEREAS, it is the desire of the City Council of Cape Girardeau, Missouri, to consider whether
such area should be annexed into the City of Cape Girardeau.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. That the City Council of Cape Girardeau, Missouri, does hereby accept and receive
a Petition for Voluntary Annexation of certain real estate, described as follows:
FRUITLAND LIVESTOCK MARKET, INC., a Missouri corporation
THAT PART OF UNITED STATES PRIVATE SURVEY NO. 790, IN TOWNSHIP 31
NORTH, RANGE 13 EAST OF THE FIFTH PRINCIPAL MERIDIAN IN THE COUNTY
OF CAPE GIRARDEAU, THE STATE OF MISSOURI, DESCRIBED AS FOLLOWS:
Commence at the northwest corner of Fractional Section 10, Township 31 North, Range 13 East,
at a found stone; thence North 84053'56" West, 1,072.50 feet, to the point of beginning; thence
South 12°55'04" West, 507.97 feet; thence North 84059'00" West, 934.56 feet; thence North
08°15'41" East, 908.46 feet; thence South 84°59'00" East, 958.41 feet, to a found iron pin; thence
South 05°47'22" West, 403.90 feet, to the point of beginning, and containing 20.00 acres, more or
less, as shown on the accompanying plat. Subject to any easements of record.
ARTICLE 2. Be it further resolved that in accordance with Chapter 71.012 RSMo it is now
ordered that a public hearing be set for November 1, 2010, at which hearing any interested person,
corporation or political subdivision may present evidence regarding the proposed annexation.
ARTICLE 3. It is further resolved that notice of said public hearing be published in a newspaper
of general circulation qualified to publish legal matters not less than seven (7) days prior to November 1,
2010.
