A RESOLUTION ACKNOWLEDGING RECEIPT OF AN
ANNEXATION PETITION FROM ARNOLD EQUITY
PROPERTIES, L.C. AND SETTING A PUBLIC HEARING
REGARDING THE PROPOSED ANNEXATION
WHEREAS, a Petition for annexation has been presented to the
City Council of Cape Girardeau, Missouri, requesting that certain
property be annexed into the City of Cape Girardeau, Missouri; and
WHEREAS, the Petition has been presented in accordance with
Chapter 71.012 Revised Statutes of Missouri, which statute provides
for voluntary annexation upon request of the affected property
owners; and
WHEREAS, it is the desire of the City Council of Cape
Girardeau, Missouri, to consider whether such area should be annexed
into the City of Cape Girardeau.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. That the City Council of Cape Girardeau, Missouri,
does hereby accept and receive a Petition for Voluntary Annexation
of certain real estate, described as follows:
ARNOLD EQUITY PROPERTIES, L.C.
THAT PART OF THE SOUTHWEST QUARTER OF SECTION 10, TOWNSHIP
31 NORTH, RANGE 13 EAST, COUNTY OF CAPE GIRARDEAU, STATE
OF MISSOURI, DESCRIBED AS FOLLOWS:
Begin at the Southwest corner of Lot 97 of The Meadows of
Whispering Oaks - Amended, a Subdivision on file in the
Land Records of Cape Girardeau County in Plat Book 23 at
Page 62; thence with the South line of said Lot North 600
27' 55" East, 172.16 feet; thence leaving said line South
270 02' 09" East, 204.88 feet; thence South 030 34' 19"
East, 192.60 feet; thence South 040 14' 52" East, 135.83
feet; thence South 020 36' 16" West, 19.92 feet; thence
South 010 41' 37" East, 78.24 feet; thence South 130 54'
40" East, 100.26 feet; thence South 760 05' 20" West,
172.00 feet; thence North 130 54' 40" West, 118.67 feet;
thence North 010 41' 37" West, 103.11 feet; thence North
020 36' 16" East, 16.08 feet; thence North 040 14' 52"
West, 126.55 feet; thence North 030 34' 19" West, 157.89
feet; thence North 270 02' 09" West, 161.65 feet, to the
point of beginning and containing 2.79 acres (121,749
square feet), more or less, subject to any easements of
record.
ARTICLE 2. Be it further resolved that in accordance with
Chapter 71.012 RSMo it is now ordered that a public hearing be set
for September 7, 2010, at which hearing any interested person,
corporation or political subdivision may present evidence regarding
the proposed annexation.
ARTICLE 3. It is further resolved that notice of said public
hearing be published in a newspaper of general circulation qualified
to publish legal matters not less than seven (7) days prior to
September 7, 2010. 0244�
