A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE AN AGREEMENT WITH 4 -SIGHT COUNSELING,
INC., TO PROVIDE HOUSING COUNSELING AND OPERATION
ASSISTANCE REGARDING THE NEIGHBORHOOD
STABILIZATION PROGRAM, IN THE CITY OF CAPE
GIRARDEAU, MISSOURI
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Manager, for and on behalf of the City
of Cape Girardeau, Missouri, is hereby authorized to execute an
Agreement with 4 -Sight Counseling, Inc., to provide housing
counseling and operation assistance regarding the Neighborhood
Stabilization Program, in the City of Cape Girardeau, Missouri.
A copy of said Agreement is attached to this Resolution and made
a part hereof.

AGREEMENT BETWEEN 4- SIGHT COUNSELING, INC. AND THE CITY OF CAPE
GIRARDEAU MISSOURI
The U S Department of Housing and Urban Development (HUD) has provided funding through the
Missouri Department of Economic Development for The Neighborhood Stabilization Program (NSP). The
purpose of this funding is for communities to purchase, rehabilitate, and sell foreclosed properties to
low and moderate income homebuyers. The City of Cape Girardeau has received this funding and is
ready to implement this program. 4 Sight Counseling, Inc. is a HUD approved Housing Counseling
Agency who will play a significant role in operating this program. This agreement is an attempt to spell
out the relationship between the City and 4 Sight Counseling, Inc.
Mutual Responsibilities
• Identification of properties for acquisition.
• Recruitment of potential homebuyers
• All program activities will be in accordance with the STATE OF MISSOURI Neighborhood
Stabilization Program Guide, 2009 CDBG Administrative Manual and the City of Cape Girardeau
Neighborhood Stabilization Program Guidelines.
Responsibilities of the City of Cape Girardeau
• Preparation of all documents, reports etc. to the Missouri Department of Economic
Development (DED).
• Development of program guidelines
• Preparation of a schedule for program completion
• Final decision on selection of properties
• Provide appraisals, title searches and closing documents.
• Provide payment for the purchase of the property to the abstract company at closing from the
NSP accounts.
• Title to the property will be held by 4 -Sight Counseling, Inc. for the City of Cape Girardeau,
Missouri.
• Preparation of rehabilitation specifications
• Development of sales agreement for the purchase of property by 4 Sight Counseling, Inc.
• Bidding of contracts
• Selection of contractors
• Developing and executing construction contracts
• Daily construction management
• Payment to contractors
• Approval of change orders by the City of Cape Girardeau and 4 -Sight Counseling, Inc.
• Final approval of the rehabilitation work by the Housing Assistance Coordinator and the Director
of 4 -Sight Counseling, Inc. and approval of final payment to contractors
• Monitoring of the housing counseling effort of 4 Sight Counseling, Inc.
• The City of Cape Girardeau will receive 5% of the administrative cost on each project from the
proceeds of the grant.
Responsibilities of 4 Sight Counseling
• Purchase agreed upon properties for the City
• Maintain ownership and liability Insurance
• Keep the property secure during construction and provide utilities, mowing and general
maintenance of the properties.
• Develop a list of potential homebuyers
• Work with the homebuyers to adequately match them with a home.
• Provide in depth housing counseling program to potential homebuyers. This program will meet
the requirements of the NSP Program.
• Assist the homebuyers in securing permanent financing on the selected properties.
• Execution of the sale of the property to the end buyer
• 4 -Sight Counseling shall not sell, mortgage or transfer any of these properties in any way
without the prior express written approval of the City of Cape Girardeau', Missouri.
• Proceeds from the sale of the property will be returned to the City of Cape Girardeau, Missouri's
NSP Accounts.
• 4- Sight Counseling, Inc. will receive 5% of the administrative cost on each project from the
proceeds of the grant.
• 4 -Sight Counseling, Inc. will invoice the City for all program costs.
Termination
• Either party has the right to terminate the contract with the other party for Cause with 30 days
written notice. Such termination must be consistent with local, state, and federal laws and
regulations.
General
Any determination or action required to be made herein by the City of Cape Girardeau may be
made by Ken Eftink, Assistant City Manager/Director of Development Services.
Any determination or action required to be made herein by 4 -Sight Counseling; Inc. may be
made by Tim Gould, President
