RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY
MANAGER TO EXECUTE AN AGREEMENT
FOR SOLID WASTE DISPOSAL RATE FOR
BEASLEY WASTE, INC., FOR USE OF
THE CITY TRANSFER STATION
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Manager, for and on behalf of the City
of Cape Girardeau, Missouri, is hereby authorized to execute an
Agreement for Solid Waste Disposal Rate for Beasley Waste, Inc.,
for use of the City Transfer Station. A copy of said Agreement
is attached to this Resolution and made a part hereof.

AGREEMENT FOR
SOLID WASTE DISPOSAL RATE FOR
BEASLEY WASTE, INC.
This Agreement is made and entered into this L day of
February, 2007 by and between the City of Cape Girardeau, Missouri,
a municipal corporation hereinafter referred to as "City", and
Beasley Waste Inc. of Thebes, Illinois, referred to as "Beasley
Waste, Inc." for and in consideration of the promises and
agreements made here and after, the City and Beasley Waste, Inc.
agree to bind themselves to the following.
1. The City of Cape Girardeau in the Solid Waste Ordinance
is allowed to set disposal rates for private haulers in
the excess of twenty (20) tons of solid waste delivered
to the transfer station per week.
2. The parties agree that the first two hundred (200) tons
per month that is received and shipped from the transfer
station will stay at the current gate rate which is
currently Thirty-eight Dollars and Seventy-five Cents
($38.75) per ton. This may be adjusted periodically by
the City Council or through State Fee adjustments.
Tonnage over two hundred (200) tons per month will have a
set rate of Thirty -Five Dollars ($35.00) per ton for
disposal.
3. The City agrees to receive up to one hundred thirty (130)
tons of solid waste per weekday. Of this one hundred

thirty (130) tons, the City will take up to thirty (30)
tons of contractor or open top container solid waste.
4. Normal transfer station weekday business hours for this
agreement will be from 7:00 AM to 3:45 PM.
5. The transfer station will be closed all Saturdays and
Sundays and the following holidays: New Years Day, Martin
Luther King Jr. Day, Presidents Day, Memorial Day,
Independence Day, Labor Day, Veteran's Day, Thanksgiving
Day and Christmas Day, or on the dates on which these
holidays are observed.
6. It is agreed by and between the parties that this
agreement does not give Beasley Waste, Inc. any advantage
over other customers.
7. The term of this agreement is from the signing date to
January 31, 2008.
8. This agreement is binding upon the successors and assigns

instrument to be the free act and deed of said City.
