Introduction As part of the Homeland Security (DHS) Appropriations Act of 2005, signed into law by President Bush on October 18, 2004, providing funding for the Fiscal Year (FY) 2005 State Homeland Security Grant Program (SHSGP). As a result, the State of Missouri has secured funding for its FY2005 SHSGP. Under the advisement of the Homeland Security Advisory Committee, the primary capability the FY05 SHSGP will fund is the FY05 Interoperable Communications Grant Program (ICGP). This program will enhance local public safety radio communications by replacing wideband -only portable and mobile radios with narrowband capable units. In addition to the acquisition of narrowband capable radios, awarded jurisdictions must agree to program the designated multi jurisdiction interoperability channels set aside by the Federal Communications Commission (FCC) and the Missouri State Highway Patrol (MSHP) into their subscriber equipment for local public safety use. These channels are more commonly called "MTAC," "UTAC," and "VTAC." By implementing these interoperability channels, agencies responding to a multi - jurisdictional event will have shared channel interoperability, as outlined in the National Interoperability Continuum. Almost two hundred (200) public safety agencies in Missouri have already agreed to implement these multi -discipline interoperability channels in their radios. Note: all the licenses pertaining to the offered interoperability channels have been obtained by the State Interoperability Executive Committee and the Missouri State Highway Patrol and come at no added expense to the user. Implementing this program will ensure agencies can meet both the Federal Communications Commission Narrowband deadline of 2013 and raise the interoperability quotient among their agencies and those operating in other disciplines around them. This grant will focus on promoting interoperability and narrow - banding to smaller jurisdictions that otherwise would experience difficulty achieving these goals without assistance. The following Federal objectives will be met once this program is implemented: 1. Address the FCC mandate requiring all wideband VHF/UHF operations to narrowband by January 1, 2013. 2. Equip all participating jurisdictions with the FCC and MSHP designated multi -discipline interoperability channels to be employed in the case of a multi jurisdictional response event. B. Pass -Through Requirements The federal Government requires that the State Administrative Agency (SAA) must obligate not less than 80% of the total grant award to local units of government allowing no more than 20% to be awarded to state government agencies throughout the term of the grant. C. Definitions and Acronyms Applicant Agency — The organization that has the authority to legally bind the agency in a contract. For an agency within a city government system (i.e. Police Department), the city is the applicant agency. For an agency within a county government system (i.e. Sheriff's Department), the county is the applicant agency. For an agency within a judicial circuit (i.e. Circuit Court, Juvenile Office), the county that provides fiscal management is the applicant agency. Contract Period — The allotted time in which the SHSGP equipment is received, installed, and fully operational. The ICGP contract period is TBA upon award and will be no later than 03/30/2007. Contractor — The recipient of an ICGP Grant contract or award. The Contractor is also the Applicant Agency. MOU — Memorandum of Understanding Project Agency— The agency that will be implementing the proposed project. Project Director — The individual who will have direct oversight of the proposed project. If the Project Agency is a law enforcement agency, the chief or sheriff must be the Project Director. Subgrantee - The recipient of an ICGP Grant contract or award. D. Eligible Applicants and Guidelines This grant will focus on promoting interoperability and narrow banding to smaller jurisdictions that otherwise would experience difficulty achieving these goals. Only political subdivisions are eligible to apply for equipment available through the Interoperable Communications Grant Program; this would include county or municipal. Any law enforcement agency or Fire Services agency (i.e., Police, Sheriff, and/or Fire Departments) that will receive radios from the FY05 Interoperable Communications Grant Program must adhere to the following applicable Missouri Revised Statues. Missouri Funding Guidelines for law enforcement agencies: Uniform Crime Reporting Requirements Section 43.505 RSMo requires every law enforcement agency in the state to submit crime reports on the forms and in the format prescribed by the Department of Public Safety. The law goes further by adding that any law enforcement agency that violates this section may be ineligible to receive state or federal funds, which would otherwise be paid to such agency for law enforcement, safety or criminal justice purposes. Note: law enforcement agencies not in compliance with the above-mentioned Missouri Revised Statute (43.505) are ineligible to apply for equipment provided through the FY 2005 ICGP. Racial Profiling Reporting Requirements Section 590.650 RSMo requires every law enforcement agency in the state to submit racial profiling reports on the forms and in the format prescribed by the Missouri Attorney General. The law goes further by adding if a law enforcement agency fails to comply with the provisions of this section, the governor may withhold any state funds appropriated to the noncompliant law enforcement agency. Note: law enforcement agencies not in compliance with the above-mentioned Missouri Revised Statute (590.650) are ineligible to apply for equipment provided through the FY 2005 ICGP. • Missouri Funding Guidelines for fire services: Filing Requirement Section 320.271 RSMo requires all fire protection districts, fire departments, and all volunteer fire protection associations as defined in section 320.300 "shall file with the state fire marshal within sixty days after August 13, 1988, and annually thereafter, the name and address of the fire protection district, fire department, or volunteer fire protection association." Note: fire service agencies not in compliance with the above-mentioned Missouri Revised Statute (320.271) are ineligible to apply for equipment provided through the FY 2005 ICGP. • Pre-FY2005 State Homeland Security Grant Program Recipients Prior grant recipients: Jurisdictions with "open" State Homeland Security grants will not be considered unless they can provide documentation showing that all funding is obligated and awaiting delivery. This includes the FY2004 City/County, Fire Grant, LETTP, and the FY2003- Part II Interoperable Communications Grant. E. Authorized Equipment The FY 2005 ICGP is intended to replace wideband -only portable and mobile radios, with narrowband capable units and to equip public safety agencies with the multi jurisdiction interoperability channels set aside by the Federal Communications Commission (FCC) and the Missouri State Highway Patrol (MSHP) for local public safety use. Equipment includes: • Portable Radios and Associated Hardware, Software, and Programming • Mobile Radios and Associated Hardware, Software, Programming, Installation Necessary radio specifications: ✓ 48 Channel capacity or more (96 recommended) ✓ Narrowband capable (the ability to locate 7.5 KHz centers) ✓ 8 character alphanumeric display ✓ 136/148-174 MHz frequency range ✓ FCC type accepted ✓ Project 25 (CAI) Common Air Interface (conventional mode) Available funding: Realizing the expense of the of the radio specifications listed above, SEMA (under the advisement of the SIEC) will reimburse all awarded applicants up to $2,000.00 per radio, but no more than actual cost. This amount includes all accessories, hardware, software, programming, and mobile installation costs associated with each awarded unit. Any expenses that exceed the total dollar amount allowed per radio will be the obligation of the applicant agency. Because this program is intended to enhance interoperable communications by means of replacement on a "one for one" basis, applicant agencies are required to decommission their current radios upon receipt of the narrowband capable radios acquired through this grant program. Therefore, if an applicant jurisdiction were awarded twenty (20) narrowband capable radios through the ICGP they are agreeing to take twenty (20) of their radios used prior to the award process out of service. F. Application Process 1. The Application: the applicant agency must complete a four-part application to be considered for the ICGP. a. Part I —the applying jurisdiction must answer several questions from the application questionnaire portion of the grant. These questions will focus on current radio capabilities relative to past homeland security grant programs and funding. Each applicant agency will receive a total score based on its responses to these grant specific questions. b. Part II — the applicant agency must submit the necessary narrative portion to be considered for this grant. This portion will include various impact statements, current MOU's, past communications projects, and current communications plans. c. Part III — the applicant agency must submit the necessary proposed budget form showing the type, unit cost, and total cost of their proposed budget. This portion will also include a decommission list, recording the make, model, and serial number of the radios the applicant agency plans to decommission upon receipt of awarded radios. Note: further guidance regarding decommissioned radios will be given upon the receipt of awards. d. Part IV — the applicant agency must submit the contact information form. All applicable fields must be complete to be considered for the ICGP. Note: be sure to sign and date all applicable fields. 2. Review panel: after the February 28, 2005 deadline has passed, a review panel, composed of various public safety subject matter experts will review all submitted materials. 3. Final scoring: the final scores for each application will be based on a combination of scores generated from the application questionnaire and the narrative submissions (scored by the reviewers) relative to the regional impact of the proposed project. 4. Awards: funding of individual awards will be made based on the total final scores recorded. Awards will be granted to the highest scores and all subsequent scores until all funding is exhausted, barring any disqualifications (i.e., noncompliance with UCR and/or Racial Profiling reporting requirements). Note: There is no guarantee of subsequent rounds of funding with this program. G. Application Submission to SEMA All grant application forms submitted to SEMA, for the FY05 LETPP application, must be postmarked by February 28, 2006. Applications postmarked after this date will not be considered for funding. Faxed applications will not be accepted. Responsibility of Awarded Agencies Jurisdictions in receipt of mobile and/or portable radios through the FY2005 Interoperable Communications Grant must assume all maintenance and upgrade expenses associated with the application of each unit: • It is the responsibility of the awarded jurisdictions to ensure all radios are programmed to utilize the designated multi jurisdiction interoperability channels set aside by the Federal Communications Commission (FCC) and the Missouri State Highway Patrol (MSHP). • Awarded subgrantees are also held responsible for the replacement and repair of lost or damaged units. • Awarded recipients must comply with the standards outlined in the United States Department of Justice, Office of Justice Programs' 2005 Financial Guide. This "Decommission List" allows the applicant agency to list all radios they plan to decommission upon receipt of the narrowband capable radio purchased through this grant program. Communications Equipment Type - List either "Mobile Radio" or "Portable Radio' in each field Make and Model - List the make and model of the radios you plan to decommission upon receipt of the narrowband capable radios if awarded a grant through this program.
