HomeMy WebLinkAboutRES.2124.12-05-2005BILL NO. 05-266 RESOLUTION NO. : J -j A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE ADDENDUM NO. 3 TO THE GENERAL SERVICES CONTRACT WITH BOWEN ENGINEERING AND SURVEYING, INC., FOR IMPROVEMENTS ON MT. AUBURN ROAD FROM INDEPENDENCE STREET TO KINGSHIGHWAY, IN THE CITY OF CAPE GIRARDEAU, MISSOURI BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1. The City Manager, for and on behalf of the City of Cape Girardeau, Missouri, is hereby authorized to execute Addendum No. 3 to the General Services Contract with Bowen Engineering and Surveying, Inc., for improvements on Mt. Auburn Road from Independence Street to Kingshighway in the City of Cape Girardeau, Missouri. A copy of said Contract is attached to this Resolution and made a part hereof. PASSED AND ADOPTED THIS - DAY OF 7 3 20 L — Jay Knudtson, Mayor AMENDMENT NO.�TO GENERAL SERVICES CONTRACT MT. AUBURN ROAD IMPROVEMENTS This supplementary agreement amends the General Services Contract, between Bowen Engineering & Surveying, Inc., hereinafter referred to as the "Engineer", and the City of Cape Girardeau, hereinafter referred to as the "City". The General�Servics Contract, between the City and Engineer, was approved on the _ day of 2005 by action of the City Council's Resolution No. This amendment is for design engineering services relating to the widening and improvement of Mt. Auburn Road. Whereas, the City intends to widen Mt. Auburn road to accommodate four through -traffic lanes and associated turning lanes at various locations from Independence Street to U.S. Highway 61 (Kingshighway), including installation of a traffic signal at Hopper Road, reconstruction of existing side street entrances and private driveways, construction of sidewalks and installation of storm sewers and other drainage features, and whereas the Engineer agrees to provide engineering services for this Project, and to complete the work, to the satisfaction of the City, and for the rates set forth in Attachment "A" of the General Services Contract. The Engineer shall develop plans for the proposed project in three stages. The City shall review the plans at the end of each stage of the development process and shall provide to the Engineer written comments on plan changes or additions. The times for completion of each stage in the project Design Phase shall be as follows_:_ Stage 1 - Preliminary Plan Development - The time from receipt of the Notice to Proceed to completion of preliminary plans shall not exceed 55 calendar days. Stage 2 - 95% Design Development - The time from receipt of preliminary plan review comments to completion of final plans and bid documents to a 95% complete state shall not exceed 65 calendar days. Stage 3 - Final Bid Package - The tirne from receipt of final plan comments to the completion of the final bid package shall not exceed 15 calendar days. If conditions outside the control of the Engineer occur, or substantial changes to the original scope of work are required by the City, the Engineer reserves the right to extend the time of completion dates in an amount to be .agreed upon by the Engineer and the City. Page A.1 ARTICLE I - SCOPE OF SERVICES A. DESIGN PHASE - The Engineer will: Assist the City in coordinating and deciding the needs and requirements of the project 2. Conduct topographic, property and utility surveys sufficient to develop, plans for the project. Survey data shall be provided in State Plane coordinates. 3. Arrange for any subcontractor services as may be required. Subcontractor fees shall be approved by the City prior to award of any subcontract work. Subcontractor fees shall be in addition to the stated fee for a specific project and shall be submitted as an additional cost on the project invoices. 4. Prepare alternate designs, cost estimates, develop preliminary plans, recommend the best design (based on these studies and develop final plans and specifications for the project as directed by the City. 5. Assist the City in securing adequate property title information, deciding right-of-way and easements required for successful execution of the project, and provide assistance to the City in acquiring right-of-way or easements. 6. Complete all permit applications necessary to insure compliance with local, state and federal requirements. 7. Prepare Specifications and Bid Documents for the Project, incorporating the City's standard specifications where available. 8. Assist the City in organizing public meetings as required. This shall include providing adjacent property owner information to City staff and attending meetings to discus; the project. 9. Attend public hearings to provide project information to City Council and answer questions relating to the proposed improvernents. 10. Provide 10 sets of final plans and specifications to the City for distribution to prospective bidders. Page A2 B. BIDDING PHASE -The Engineer will: Provide the City with a list of qualified bidders and assist the City it advertising for bids. 2. Assist the City in evaluating bids and recommending a Contractor. C. CONSTRUCTION PHASE -The Engineer will: Assist the City with a pre -construction conference to discuss project details with the Contractor. 2. Provide construction staking for the Contractor as set forth in the project specifications. This work will generally include setting paving hubs, staking new and relocated storm sewer structure locations, marking right of way and easement limits and providing elevation benchmarks. This information will be provided to the Contractor one time. Any additional staking or re -staking shall be paid for by the Contractor. 3. Complete As -Built plans to determine project quantities and to identify constructed location of pavement, storm sewer and other utility structures. Both paper drawings and digital files depicting the As -Built conditions will be provided to the City. All digital files shall be in State Plane coordinates. The Engineer will provide these services for the hourly rates set forth in the Engineering Services Contract Attachment "A-1 ". The not -to -exceed fee for the Design Phase and the Bidding Phase of this project is $82,750.00. The not -to -exceed fee for the Construction Phase of this project is $22,250.00. Progress reports shall be submitted with each monthly pay request. All Articles of the General Services agreement apply to this amendment, as if fully set forth herein.
