A RESOLUTION AUTHORIZING THE CITY MANAGER TO
SUBMIT A STORMWATER MANAGEMENT PROGRAM TO THE
MISSOURI DEPARTMENT OF NATURAL RESOURCES
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Manager, for and on behalf of the City
of Cape Girardeau, Missouri, is hereby authorized to submit a
Stormwater Management Program to the Missouri Department of
Natural Resources. A copy of said Stormwater Management Program
is attached to this Resolution and made a part hereof.

I- BACKGROUND
The City of Cape Girardeau was established in 1871. The City has a population of 36,687 according to the
2000 Census information, with a total area of 26.41 square miles (City of Cape Girardeau GIS information).
The City of Cape Girardeau has a council-manager form of government. The City council consists of a mayor
and six council members (see attachment 1 for their names, terms and addresses). The major water sheds of the
City are Juden Creek, Sloan Creek, Cape La Croix Creek, Ramsey branch and the Headwater diversion
channel, all of which discharge into the Mississippi River (see attachment 2).
The City of Cape Girardeau has a storm water ordinance that was adopted in 1989. The storm water ordinance
aims at controlling the rate of discharge from new development and enforcing erosion control measures to
reduce the amount of silt deposited into waterways. The City Engineer's office has a set of erosion and
sediment control standards that have been enforced on all construction projects within the City limits of the
City of Cape Girardeau regardless of the area of land disturbed. In 2002 the Development Services department
began requiring developers to submit proposed erosion control plans and notes for review and approval with
their grading and storm water management plans.
The City of Cape Girardeau City Council is in the process of presenting a proposed storm water utility charge
to the voters in the upcoming April 2003 election, as recommended by the citizens task force. This charge will
go toward hiring a storm water coordinator whose main responsibility will be to oversee the execution of the
phase II stormwater management plan. The storm water utility charge would also pay for several storm water
projects to improve and enhance the storm water sewer system and help maintain the different creeks that flow
through town. However, if the storm water utility does not get approved, the Storm -water Management
Program will have to be re-evaluated at that time.
The City of Cape Girardeau has been and still is committed to reducing the levels of contaminants, silt and
other deposits from the storm water going through the City. However, the City has little or no control on what
occurs outside the City limits. Therefore, the City will continue to coordinate with the county, City of Jackson
and regional agencies.
II- INTRODUCTION
The City of Cape Girardeau has formed a Storm Water Management (SWM) team that shall oversee the
development and implementation of the Storm Water Management Program (SWMP). The SWM team shall
meet on a regular basis to review reports, address storm water management issues and to monitor the progress
of the SWMP implementation. The team is comprised of individuals from Planning, Engineering, Inspection
Services and Public Works. The Storm Water coordinator shall consult the team on storm water issues and
problems and submit progress reports for the team's review and recommendations.

This SWMP shall identify specific objectives for each of the required control measures and which department
or division shall be responsible for the implementation and enforcement of that measure. The plan will set
forth a guideline for inspection and enforcement of all approved storm water management plans, and erosion
and sediment control plans in accordance with existing ordinances. It will also make proposals for
recommended changes and addendums to existing ordinances.
This SWMP will be reviewed and updated annually in conjunction with annual reporting requirements, or as
required by the director of the U.S. Environmental Protection Agency and Missouri Department of Natural
Resources (MODNR), in accordance with statutory provisions of section 402(p)(3)(B) of the Clean Water
Act.
III- PERMITTING AND REPORTING
The operating permit issued by the permitting authority will contain the approved SWMP in which the
objectives are:
1) to reduce the discharge of pollutants to the "Maximum Extent Possible" (MEP),
2) to protect water quality and
3) To satisfy the water quality requirements of the Clean Water Act.
In order to meet these objectives, the City will work to successfully implement the Best Management
Practices (BMPs) in the approved SWMP in compliance with the technical standard of the MEP.
A report will be prepared semi-annually detailing the status of compliance with permit conditions, including
an assessment of the appropriateness of the selected BMPs and progress toward achieving the selected
measurable goals for each minimum measure. The report will also provide results of any information
collected and analyzed such as monitoring data (if any), if collected as well as any recommended changes in
the BMPs and measurable goals for any of the required minimum measures. The City's annual report to the
permitting authority will include a summary of the semi-annual reports as well as a summary of the storm
water activities planned for the next reporting cycle.
All records and reports will be maintained for a minimum of three years and will be made accessible to the
public. Upon request, copies of records and reports will be submitted to the permitting authority.
IV- STORM WATER MANAGEMENT PROGRAM
A. Public Education and Outreach
The City of Cape Girardeau believes that educating the public is an essential part of incorporating the new
phase II changes into permanent practice. Due to the complexity of the changes the City would attempt to
create a volunteer organization that would be made up of citizens from the City of Cape Girardeau. The
Citizens Storm Water Committee would have the following objectives:
• Develop educational resources

• Develop an infrastructure resource to support the public education and outreach program.
• Develop brochures to support the Public Meetings.
• Identify and train volunteer educators to be used for a Public Education Task Force.
The volunteer organization would work hand in hand with the Stormwater Team that the City already has in
place. Between these two teams, Best Management Practices would be adopted and enforced by the City. The
following educational resources would be utilized:
1. Utility Bill Insert- The City is able to add information to the monthly statement that is mailed
to customers that receive City services. Information concerning the new laws and regulations
would be attached to the statements.

3. Channel 5 -This cable television station is owned and operated by the City of Cape Girardeau.
This channel would be used to broadcast informational messages about the changes as well as
interviews with different people who will talk about the importance of the new changes and
how these changes affect the citizens of the City.

5. Employee Education- The first group that would need to be educated on the new laws and
regulations would be the employees of the City. This would be accomplished by Citywide
emails, general meetings that would outline the changes, and articles in the monthly
newspaper.

6. Contractors/Engineers/Architects Meetings- The City of Cape Girardeau would attempt to
sponsor storm water management seminars through grants or other sources. These meetings
would be targeted at the people that deal with designing or construction of stormwater
utilities. These meetings will discuss the new regulations as well as demonstrate the most
efficient way of installing erosion and sediment control measures

7. Public Meetings- The City would host public meetings that would be targeted at the citizens
of the City. These meetings would inform the public of the EPA regulations and the impact
they would have on the community and its residents. The meetings would also discuss BMP's
and the way residents could be involved in enforcing the new requirements. Brochures
produced by volunteer groups and approved by the Storm Water Management team would be
available to the public at many different locations as well. The first year the City will target
civic groups with power point presentations.

B. Public Participation/Involvement
An essential part of the phase Il changes will be involving the public with the program. The Citizens Storm
Water committee would govern the basis and demand for the programs.
Measure Objectives:
• Develop educational resources and an infrastructure resource to support the public education
and outreach program
• Education program in place and making presentations in the schools. Volunteer
educators/Speakers giving workshops.
• Public Meetings in several different locations Citywide, information available to the public in
the form of flyers or brochures. Volunteer Group organized and educated.

C. Construction Site Runoff Control

The City of Cape Girardeau had been enforcing the existing stormwater ordinance that controls construction
site runoff and illicit discharge of pollutants into local rivers, lakes and streams. Existing City of Cape
Girardeau regulations and best management practices:
❑ Stormwater ordinance that regulates mechanism requiring the implementation of proper
erosion and sediment control on construction sites of any size.
❑ Have procedures for site plan review of all commercial construction plans.
❑ Have procedures for City and commercial projects inspections and enforcement of control
measures.
❑ Have sanctions to ensure compliance (established in the stormwater ordinance).
For this measure the City' Storm Water Management team would have the following objectives:
• Review the current stormwater ordinance.
• Outline a procedure for site plan review of construction plans that have potential �v atcr

• Setup sanctions to ensure compliance.
• Identify sediments and commonly discharged pollutants.

D. Post -Construction Runoff Control
The Phase II Final Rule requires an operator of a regulated small Municipal Separate Storm Sewer System
(MS4) to develop, implement, and enforce a program to reduce pollutants in post -construction runoff to their
MS4 from new development and redevelopment projects that result in the land disturbance of greater than or
equal to 1 acre. The small MS4 operator is required to:
• Develop and implement strategies that include a combination of structural and/or non-
structural Best management practices (BMPs).
• Have an ordinance or other regulatory mechanism requiring the implementation of post -
construction Runoff controls to the extent allowable under State, Tribal or local law.
• Ensure adequate long-term operation and maintenance of controls.
• Determine the appropriate best management practices (BMPs) and measurable goals for this
minimum control measure.
The volunteer organization and the City Stormwater Team would work together to compile the following Best
Management Practices that would be adopted and enforced by the City.
1. Identify Best Management Practices for this measure. Realize and develop a mix of Structural
and Non -Structural BMPs that are appropriate for this geographic area. This -BMP list will
include BMPs suited for both redevelopment and new development and will also be used in
the 'Construction Site Runoff Control'.

E. Illicit Discharge Detection and Elimination Plan
The city of Cape Girardeau performs several tasks to reduce illicit discharges.
❑ Annual Collection of Household Hazard Waste
Every October the city of Cape Girardeau conducts a Household Hazardous Waste Collection
Day. In October 2002, 245 residents participated in this event. A total of 22,095 pounds of
hazardous waste was collected.
❑ Storm Sewer Inlet Stenciling Program
Community groups have stenciled storm sewer inlets with "Do not dump waste — goes to
stream." Currently approximately 25% of storm sewer inlets have been stenciled.
❑ Storm Sewer System Mapping Program
Approximately 20% of the City's Storm Sewer System has been entered in the City's Graphic
Information System (GIS). Most of the remaining data is on engineering drawings.
❑ City of Cape Girardeau Ordinances
The City has several ordinances addressing runoff and polluting streams.

Current Pollution Prevention/Good Housekeeping performed by City of Cape Girardeau:
❑ Street sweeping and disposal of street sweeper debris.
Normally the City operates two street sweepers on designated routes. All city streets are
swept at least 10 times per year. The inorganic materials are separated and recycled (rocks,
sand etc.) with the remaining trash disposed in a licensed landfill.
❑ Disposal of vehicle waste liquids at City garage.
All vehicle lubricants, antifreeze and other waste liquids are collected and disposed of by a
licensed contractor.
❑ Disposal of parts cleaning solvents.
Parts cleaning solvents are stored properly and disposed of by a licensed contractor.

The city's vehicle batteries are transported to a recycling company.

Tile city's used tires are collected and shredded by a state approved tire shredder.

wastewater treatment plant. All city solid waste is hauled to a Subtitle D approved landfill in
Dexter under a contractual arrangement.
❑ Fleet Equipment Wash Bay
The fleet equipment wash bay is equipped with an oil separator to prevent wash water runoff
from contaminating surrounding streams.
❑ Oil and Fuel Spills
Any oil or fuel spills are contained and cleaned up with absorbent material for proper
disposal.
❑ Fuel Storage Tanks
The pipe gallery is inspected regularly and is equipped With the latest leak detection
equipment and meets all storage tank regulations.
❑ Environmental Study of Public Works Maintenance Facility and City Maintenance Garage
Contracted with an environmental engineer for soil testing and analysis. No problems were
detected but additional testing was recommended.
❑ City leaf collection program
In 2002 approximately 1,200 tons were collected city-wide and recycled to area farms
preventing organic contamination of streams.
❑ City-wide clean up program
Last year this annual program collected 191 tons of refuse and 234 appliances from City
residents free -of -charge. The refuse was disposed of in a licensed landfill and any compressor
oil and refrigerant was removed from appliances before disposal.
❑ City-wide household hazardous waste collection
Every October the City of Cape Girardeau conducts a Household Hazardous Waste
Collection Day. In October 2002 - 245 residents participated in this event. A total of 22,095
pounds of hazardous waste was collected.
❑ Preventative maintenance program for city vehicles
This program results in early detection and correction of fluid leaks thus preventing
contamination of parking areas.
❑ Plant Two water treatment by-product disposal
Iron and manganese sludge from the Plant II water treatment processes is stored in non -
discharge lagoons, which are pumped out each year. It is then taken to wastewater treatment
plant for proper disposal.

❑ Collection of inlet debris and subsequent disposal
The Stormwater/Sewer Maintenance personnel routinely clean storm inlets and catch basins
and haul the collected material to the wastewater treatment plant for proper disposal.
❑ City landfill closure and monitoring
The solid waste landfill was closed in accordance with Subtitle D Regulations in 1989. The
leachate collection system and lagoon were eliminated in 1999 in compliance with Missouri
DNR requirements. There is no off-site discharge of leachate, although the closed landfill
continues to be inspected regularly by DNR and city staff.
❑ Weed control near streams.
Public Works personnel use Rodeo (EPA approved) herbicide for weed control near streams.
Department licensed employees apply the herbicide using recommended application
techniques and quantities.
❑ Park Department herbicide application
In the Parks Department herbicide and fertilizer is applied by two employees who hold
herbicide and fertilizer application licenses. They apply the herbicide and fertilizer using
recommended application techniques and quantities. The herbicide is stored inside a building
under lock and key.
:j Airport herbicide application
Herbicide is applied by licensed Public Works employees for the City of Cape Girardeau
Municipal Airport. Fuel tanks and loading facilities have berms to contain major fuel spills.
Airport employees are trained and have absorbent material to clean up small spills.
