A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF CAPE GIRARDEAU,
MISSOURI, SUPPORTING A CHANGE IN THE
STATE MOTORCYCLE HELMET LAW
WHEREAS, Section 302.020.2 of the Revised Statutes of Missouri
currently requires every person operating or riding as a passenger
on any motorcycle or motortricycle, as defined in Section 301.010,
RSMo, upon any highway of this state shall wear protective head
gear at all times the vehicle is in motion; and
WHEREAS, that section requiring motorcyclists to wear helmets
does not contain any exception for participation in parades; and
WHEREAS, due to the pageantry involved and the use of very
slow moving vehicles, other state safety statutes such as Section
304.665 RSMo regarding riding in the bed of a pick-up truck,
provide an exception for duly authorized parades; and
WHEREAS, the Legislature's passage of an amendment to Section
302.020.2 RSMo to allow motorcyclists and their passengers to ride
in parades without the necessity of wearing helmets would be
consistent with other Missouri state statutes and would encourage
and promote the use of motorcycles in parades around the state.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. That the Mayor and City Council of the City of
Cape Girardeau, Missouri, support an amendment to Section 302.020.2
of the Revised Statutes of Missouri which would allow motorcyclists
and motortricylists, and their passengers, to ride in duly
authorized parades without the necessity of wearing a helmet.
