A RESOLUTION AUTHORIZING THE CITY
MANAGER TO EXECUTE A STORM WATER
GRANT AGREEMENT WITH THE MISSOURI
DEPARTMENT OF NATURAL RESOURCES, IN
CONJUNCTION WITH THE BROADWAY STREET
IMPROVEMENT
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Manager, for and on behalf of the City of
Cape Girardeau, Missouri, is hereby authorized to execute a Storm
Water Grant Agreement with the Missouri Department of Natural
Resources for Broadway improvements, Clark Avenue to Perry Avenue,
and is hereby authorized and directed to furnish such information
as the Missouri Department of Natural Resources may reasonably
request in connection with said stormwater grant, to sign all
necessary documents on behalf of the City, to furnish such
assurances to the Missouri Department of Natural Resources as may
be required by law or regulation, and to receive payment on behalf
of the City. A copy of said Grant Agreement is attached to this
Resolution and made a part hereof.

C. PROJECT DESCRIPTION
Installation of 35 stormwater inlets, improvement to the detention lagoon, construction of
a box culvert at the Forest Avenue intersection. This is to improve collection of storm
water in the 180 -acre drainage along Broadway Street from Clark Avenue to Perry
Avenue.

By signing this agreement, the recipient certifies that:
A. the facilities, when completed, will be owned, operated, and maintained by a
political subdivision of the state;
B. contract documents and construction bidding will conform to relevant local, state,
and federal laws;
C. all necessary easements and land have been/will be obtained or condemnation
proceedings begun prior to advertisement for bids;
D. the recipient will construct the project or cause it to be constructed to final
completion in accordance with approved plans and specifications;
E. all state storm water grant funds will be expended solely for carrying out the
approved grant project;
F. a professional engineer registered in Missouri has been/will be selected and will
perform the services outlined in the project;
G. the local share is available to complete the project;
H. any required United States Army Corps of Engineers Section 404 permits for
dredging or placing fill material in waters of the United States have been/will be
obtained;
I. any required Storm Water Permits for land disturbance involving areas greater
than 5 acres have been/will be obtained prior to advertisement for bids;
J. state wage rates will be used in the construction of this project if not constructed
by force account.
1. Schedule:
A. The comprehensive storm water drainage plan should be submitted no later than
June 1, 2000.
B. Plans and specifications should be submitted no later than August 31, 2000 to
allow sufficient time for review and approval by October 30, 2000.
C. Significant contracts must be awarded by December 31, 2000.
2. For procurement of construction equipment, supplies, and construction services in
excess of $25,000 awarded by the recipient for any storm water project other than
costs directly related to force account work:
A. Each contract shall be awarded after formal advertising.
B. The contract award shall be to the lowest responsive and responsible bidder.
C. Missouri Department of Natural Resources (MDNR) concurrence with the
contract award must be obtained if fewer than three bidders submit bids or if the
recipient wishes to award the contract to other than the low bidder. The recipients
shall forward the tabulation of bids and a recommendation of contract award to
the Department for review.
3. Grant payments will be made in no more than two installments.
A. The first payment may be made when not less than 50 percent of the construction
of the project is complete.
B. The second payment may be made when the project is completed and approved
by MDNR.
Payment requests must be accompanied by supporting invoices.
4. Grants are limited to one third of eligible costs or to the grant amount, whichever is
less.
5. Change orders must be approved by MDNR. Grantee agrees to pay any further
expense resulting from a change order if grant amount is exceeded.
6. Authorization to advertise for bids must be received from MDNR prior to
advertisement for bids.
7. Projects in which construction has already begun without MDNR review and
approval of engineering documents must meet the following requirements:
A. The project is in compliance with the Storm Water Assistance Regulation (10
CSR 20-4.060) and the conditions of the grant agreement, except for the
requirement to obtain MDNR approval of the basin plan, the design criteria, and
the construction plans and specifications prior to advertisement for bids.
B. The basin plan, the design criteria, and the construction plans and specifications
must be submitted to MDNR for review and found to be approvable.
8. Failure to award all significant construction contracts for this project prior to
December 31, 2000 will result in termination and recovery of this grant.
9. MDNR will establish eligibility for this project or portions thereof as plans and
specifications are developed. If necessary, the grant amount will be adjusted
downward to reflect this determination.
10. Repayment of the grant is required if the applicant fails to obtain and meet reporting
requirements of all MDNR permits for all facilities owned by the recipient.
By signing this grant agreement, the grantee acknowledges and agrees to the conditions
set forth herein.
THE STATE OF MISSOURI HEREBY OFFERS A STORM WATER GRANT OF
$91,344.00 TO THE C ITY OF CAPE GIRARDEAU.
