RESOLUTION NO.
A RESOLUTION ACKNOWLEDGING RECEIPT OF AN
ANNEXATION PETITION AND SETTING A PUBLIC
HEARING REGARDING THE PROPOSED ANNEXATION
WHEREAS, A Petition for Annexation have been presented to the
City Council of Cape Girardeau, Missouri, requesting that certain
properties be annexed into the City of Cape Girardeau, Missouri;
and
WHEREAS, the Petition has been presented in accordance with
Chapter 71.012 Revised Statutes of Missouri, which statute provides
for voluntary annexation upon request of the affected property
owners; and
WHEREAS, it is the desire of the City Council of Cape
Girardeau, Missouri, to consider whether such areas should be
annexed into the City of Cape Girardeau.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. That the City Council of Cape Girardeau, Missouri,
does hereby accept and receive a Petition for Voluntary Annexation
of certain real estate, described as follows:
Robert A. Drury, Owner, RAD Investments.
A PART OF UNITED STATES PRIVATE SURVEY NO. 175, TOWNSHIP
30 NORTH, RANGE 13 EAST OF THE FIFTH PRINCIPAL MERIDIAN,
COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI, BEING MORE
PARTICULARLY DESCRIBED AS FOLLOWS:
Commencing at a ?" iron pin being the northwest corner
of lot 14 of Cape West Third Subdivision as recorded in
the land records of the County Recorders Office in plat
book no. 16 at page no. 82; from which a 2" iron pin
being the southwest corner of said lot bears, S 270 10'
54" E, 415.00 feet; Thence with the prolongation of the
west line of said subdivision, N 27° 10154" W, 163.51
feet to the TRUE POINT OF BEGINNING,
said point being the northeast corner of a tract of land
as recorded in book no. 552 at page no. 633; Thence along
the north line of said tract, N 850 01135" W, 1523.20
feet to the northwest corner of said tract and to a point
on the west line of U.S.P.S. no. 175; Thence leaving said
north line and along the west line of U.S.P.S. no. 175,
N 060 54' 52" E, 840.17 feet to the northwest corner of
U.S.P.S. no. 175; Thence leaving the aforesaid west line
and along the north line of U.S.P.S. no. 175, S 850 01'
35" E, 966.88 feet to point on the westerly line of a
tract of land recorded in book no. 653 at page no. 325;
Thence leaving the aforesaid north line and along the
westerly line of said tract of land, S 270 10154" E,
991.82 feet to the TRUE POINT OF BEGINNING, containing
24.00 acres more or less.
ARTICLE 2. Be it further resolved that in accordance with
Chapter 71.012 RSMo it is now ordered that a public hearing be set
for January 3, 2000, at which hearing any interested person,
corporation or political subdivision may present evidence regarding
the proposed annexation.
ARTICLE 3. It is further resolved that notice of said public
hearing be published in a newspaper of general circulation
qualified to publish legal matters not less than seven (7) days
prior to January 3, 2000.
