A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE AUTHORIZATION NO. 9 TO THE MASTER
SERVICES AGREEMENT WITH BURNS & McDONNELL
ENGINEERING COMPANY, INC. FOR THE POTABLE
WATER TREATMENT SYSTEM
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Manager, for and on behalf of the City of
Cape Girardeau, Missouri, is hereby authorized to execute

AUTHORIZATION NO. 9 — RISK MANAGEMENT PLAN
For
PROFESSIONAL ENGINEERING SERVICES
To
BURNS & McDONNELL ENGINEERING COMPANY, INC.
St. Louis, Missouri
In accordance with the AGREEMENT for PROFESSIONAL ENGINEERING SERVICES dated
March 21, 1994 between the City of Cape Girardeau, Missouri (hereinafter called OWNER) and
Burns & McDonnell Engineering Company, Inc. (hereinafter called ENGINEER), OWNER
hereby authorizes ENGINEER to proceed with the following services:
I. SCOPE
This Authorization No. 9 covers services involved in development of Risk Management Plan
(RMP) under section I I 2 of the Clean Air Act for the Cape Rock Water Treatment Plant. A
detailed description of the scope of services to be completed by Engineer and major assumptions
upon which ENGINEER will rely in providing these services are presented in "Exhibits A and
B."
II. TIME OF SERVICE
ENGINEER will proceed with providing the services set forth herein within seven (7) days upon
authorization from OWNER, and will complete these services by no later than June 21, 1999,
assuming a Notice -to -Proceed on or before April 15, 1999.
It is understood that completion according to this schedule is contingent on the timely review by
OWNER of submittals from ENGINEER, as does not contain contingency for any delay created
by events beyond the control of the ENGINEER (such a adverse weather conditions, regulatory
agency actions, force majeure events, etc.).
III. COMPENSATION
A. Amount of Payment
1. For services performed, OWNER shall compensate ENGINEER for providing the
services set forth herein in accordance with the terms of the existing Agreement, as
follows:

a. For time spent by personnel, payment at the hourly rates indicated in the
Schedule of Hourly Labor Billing Rates Form BMR899. Such rates include
overhead and profit. The schedule is effective to December 31, 1999.
b. For expenses incurred by ENGINEER, such as authorized travel and
subsistence including airfare, food, lodging, automobile rental, commercial
services, and incidental expenses, the cost to ENGINEER plus 10 percent.
C. For reproduction, printing, long-distance telephone calls, facsimile
transmissions, company vehicle usage, testing apparatus, computer services and
computer-assisted drafting (CAD), amounts will be charged according to the
ENGINEER standard rates in effect at the time service is provided.
2. The payment for the Scope of Services described in this Authorization 9 shall not
exceed the maximum amount of Fourteen -Thousand -Five -Hundred Dollars ($14,500).
ENGINEER shall invoice OWNER monthly for work done on this project.

EXHIBIT A
LIST OF ANTICIPATED MAJOR WORK TASK
Kick Off Meeting will be held in Cape Girardeau, Missouri. The goals of the meeting are:
• Confirm all the data required for modeling, including chemicals, quantities, locations,
meteorological data, passive mitigation devices, etc. for Offsite Consequence Analyses.
• Confirm what information will be provided to the ENGINEER, and what items the
ENGINEER will determine. Some information like Dun and Bradstreet Numbers would
be best provided by the OWNER.
• ENGINEER will discuss preliminary identification of worst case and alternative release
scenarios with OWNER to obtain agreement on both scenarios.
• Determine the sites' five-year accident history.
2. Document the sites' five-year accident history.
3. Following agreement on the defined scenarios, one risk management chemical (chlorine) will
be modeled for offsite consequence analyses. EPA's modeling software, RMP*Comp, will
be used to evaluate the toxic gas endpoints associated with chlorine. One "worst case" and
one "most likely" case scenario will be developed for each site.
Develop a summary of the potentially affected population and public receptors using
Landview III, which contains the US Census Bureau Tiger database, as well as the latest topo
map from the US Department of Interior, Geological Survey.
Following completion of the modeling analysis, and if desired by the owner, ENGINEER
will overlay the model -determined toxic endpoint over a MARPLOT plot, or a 75 minute
USGS map or aerial photograph, if readily available from OWNER.
4. Assist in the development the site's Management System to meet the requirements of RMP.
ENGINEER will draft Management System based on the OWNER's inputs for the
OWNER'S review. Then ENGINEER will document the system.
5. Review OWNER'S Accidental Release Prevention Procedures and make recommendations
to upgrade these procedures for an Accidental Release Prevention Program, as necessary. It
is our understanding that OWNER'S operations and maintenance procedures are in place, but
need to be documented. The Process Safety Information, and procedures covering Hazard
Review, Training, Incident Investigation, and Compliance Audit for the chlorine process will
be developed. The Hazard Review will be done jointly by the ENGINEER and OWNER,

lead by the ENGINEER. The training will be outlined by the ENGINEER and the training
conducted by the OWNER. After OWNERS review, the ENGINEER will complete the
Process Safety Information, and procedures covering Hazard Review, Training, Incident
Investigation, and Compliance Audit.
6. Review OWNER'S Emergency Management Procedures and make recommendations to
upgrade these procedures for an offsite Emergency Response Program as necessary. For the
cost estimate it was assumed that the preliminary Emergency Management Procedures would
be drafted by the ENGINEER, for the OWNERS review, then completed by the ENGINEER.
7. Compile the RMP elements for OWNER'S review and comments.
8. Assist OWNER with the RMP Executive Summary. The ENGINEER will draft a RMP
Executive Summary based on the OWNER's inputs for the OWNER's review. Then
ENGINEER will put the Executive Summary into RMP* SUBMIT.
9. ENGINEER will draft Program Certifications for OWNER.
10. ENGINEER will insert all the information into RMP* SUBMIT, and label the diskettes for
submission. Two paper copies of the Risk Management Plan will be provided to the
OWNER.
11. ENGINEER is prepared to assist Owner in Program implementation and communication with
the Public but no significant effort is anticipated.

• A Risk Management Plan is required for only the Cape Rock Water Treatment Plant.

• No significant effort required for Program implementation or communication with the Public.
