A RESOLUTION ACKNOWLEDGING RECEIPT OF AN
ANNEXATION PETITION AND SETTING A PUBLIC
HEARING REGARDING THE PROPOSED ANNEXATION
WHEREAS, a Petition for Annexation has been presented to the
City Council of Cape Girardeau, Missouri, requesting that certain
property be annexed into the City of Cape Girardeau, Missouri; and
WHEREAS, the Petition has been presented in accordance with
Chapter 71.012 Revised Statutes of Missouri, which statute provides
for voluntary annexation upon request of the affected property
owners; and
WHEREAS, it is the desire of the City Council of Cape
Girardeau, Missouri, to consider whether such area should be
annexed into the City of Cape Girardeau.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. That the City Council of Cape Girardeau, Missouri,
does hereby accept and receive a Petition for Voluntary Annexation
of certain real estate, described as follows:
MISSOURI STATE HIGHWAY AND TRANSPORTATION COMMISSION.
A part of United States Private Survey Nos. 174, 175 and
679, Township 30 North, Range 13 East of the Fifth
Principal Meridian, City and County of Cape Girardeau,
State of Missouri being more particularly described as
follows:
Beginning at the intersection of the West Right of Way
Line of Interstate 55, Station 1267 + 66.16, 180 feet
right, and the North Right of Way Line of the Highway 74
Relocation, Station 22 + 66.16, 180 feet left; thence
along the former West Right of Way Line of Interstate 55
the following courses and distances, South 210 17' 50"
East, 1483.84 feet to a point; thence South 380 11' 58"
East, 189.17 to a point; thence South 210 17' 50" East,
413.80 feet to a point; thence leaving the former West
Right of Way Line of Interstate 55 along the new West
Right of Way Line of Interstate 55 the following courses
and distances, South 680 42' 10" West, 75.00 feet to a
point; thence North 310 33' 12" West, 168.49 feet to a
point, thence North 390 43' 56" West, 183.41 feet to a
point, thence North 550 35' 45" West, 182.78 feet to a

East, 566.16 feet to the point of beginning. Containing
approximately 29.9 acres.
ARTICLE 2. Be it further resolved that in accordance with
Chapter 71.012 RSMo it is now ordered that a public hearing be set
for January 19, 1999, at which hearing any interested person,
corporation or political subdivision may present evidence regarding
the proposed annexation.
ARTICLE 3. It is further resolved that notice of said public
hearing be published in a newspaper of general circulation
qualified to publish legal matters not less than seven (7) days
prior to January 19, 1999.
