The Interim City Manager, for and on behalf of the City of Cape Girardeau, Missouri, is hereby authorized to execute Amendment No. 1 to a General Engineering Services Agreement with Horner and Shifrin, for River Flood Protection/Levee System Certification, in the City of Cape Girardeau, Missouri . Rediger, Mayor City of Cape Girardeau City Hall 401Independence Cape Girardeau,Missouri 63703 Dear Mayor Rediger: The Department of Homeland Security's Federal Emergency Management Agency(FEMA)is producing a new countywide Flood Insurance Study(FIS)report and Digital Flood Insurance Rate Map(DFIRM) for Cape Girardeau County, Missouri. As part of this effort, we requested that information on the Cape Girardeau Levee System be submitted in order to accredit it for base(one-percent-annual-chance) flood protection on the new DFIRM. On Apri129, 2013,FEMA received supplemental materials that Horner& Shifrin, Inc. submitted on behalf of the City of Cape Girardeau in support of the Cape Girazdeau Levee System's accreditation. The materials were submitted to demonstrate the Cape Girardeau Levee System's compliance with the minimum certificarion requirements outlined in Title 44 of the Code of Federal Regulations, Section 65.l 0(44 CFR 65.]0). FEMA has reviewed and accepted the Cape Girazdeau Levee System as complying with 44 CFR 65.10. In the future, FEMA will initiate a physical map revision project that will remove the Provisionally Accredited Levee(PAL)designation to show the Cape Girardeau Levee System as fully accredited. ("Engineer"). SECTION 1 - SCOPE OF WORK Introduction: The OWNER requires assistance in conducting technical reviews, investigating field conditions and locating instructions and records relating to the Mississippi River ffood protections system and documentation of evidence showing conformance of the City's Mississippi River flood protections system with 44CFR 65-10. The ultimate use of this documentation will be to provide the basis for subsequent certification of such compliance, thus enabfing the system to be re-accredited by the Federal Emergency Management Agency ("FEMA") for flood mapping purposes. Objectives: The objectives of this work are described in the major tasks below. The Engineer's efforts will inc/ude the fol/owing tasks necessary for reaccreditation but it is express/y understood by the OWNER and ENGINEER that these efforts by the Engineer shall not be construed as "certifying"compliance with 44CFR 65-10 or a guarantee of the performance of the f/ood contro/system(s). Such "certification"can not be offered until professional liability insurance policies are rewritten to include coverage for this work. In order to furnish evidence of compliance with 44CFR 65-10, Engineer shall accomplish the following major tasks: 1. Prepare an inventory checklist for Owner's staff to use in locating and assembling material for review by Engineer. 2. Perform site visit(s) to include onsite examinations of physical system for the purpose of examining the levees, floodwalls, pump stations and gravity outlets. 3. Examine and prepare detailed list of available construction documents, including surveys, plans & specifications, as-builts and soil and materials tests and other available documents. 4. Examine operations, inspections and maintenance procedures. In particular verify the presence and extent of O&M manual, availability of maintenance records, and records of in-house and COE inspections 5. Provide a letter report summarizing findings of material examined during the site visit, and outlining the material what we will subsequently review. 6. Establish contact with Readiness Branch, St. Louis District Corps of Engineers and Mitigation Section, FEMA Region VII on behalf of OWNER, and provide a copy of the letter above. 7. Conduct a detailed review to identify remaining items needed to complete for compliance with 44CFR65.10, or additions and amplifications to items which are present but insufficiently detailed. 8. Prepare detailed scope and task list for items found necessary for compliance e.g.; Elevation and topographic survey and documentation of elevations with respect to the Corps of Engineers Upper Mississippi River Flow Frequency Study (UMRFFS); Geotechnical investigation and analyses; Provide an (updated) interior flooding anatysis if appropriate; Modify, where appropriate, the O&M procedures manual and provide necessary supplements and appendices Services ENGINEER will provide necessary narrative documentation, maps and exhibits, and other information which may be required to support the statements and conclusions reached. ENGINEER will also communicate with state and federal agencies as needed, and provide such.civil and hydraulic engineering analyses necessary to support the statements and conclusions. Coordination ENGINEER will perform the above work on the basis of information furnished by OWNER. SECTION 2— ESTIMATED COST For purposes of providing information for your budgeting, we propose to begin with Items 1 through 6 Estimate effort for items 1-6 will require approximately 60 to 80 man-hours hours to accomplish, including two persons for the site visit, at a probable fee of approximately $6000 to $7500 plus reimbursable expenses. Based upon our findings for items 1-6, we will subsequently provide a detailed scope and estimate for the following items 7 and 8, to be performed under a subsequent amendment. RESPONSIBILITIES OF OWNER It is ENGINEER's understanding that OWNER will provide the following assistance, information, and/or related elements: A. Assistance by placing at ENGINEER's disposal all available current information pertinent to this assignment; including previously developed plans, specifications, reports, permits, and other data. B. Appropriate liaison with the OWNER'S staff involved in this effort. C. Reasonable access to other data and records related to this assignment that ENGINEER may determine a need for. OWNER shall be responsible for, and ENGINEER shall rely on correctness of information, drawings, etc. made available by the OWNER, without the need for verification. _. COMPENSATION A. Amount of Payment and Statements 1. Engineer proposes to complete the above Scope of Services (Item 1 through Item 6) at our hourly rates described in Attachment A to a maximum amount of Seven Thousand Five Hundred Dollars ($7,500) and Reimbursable Expenses described in Attachment B. In the event that additional work is required, OWNER will be informed at the earliest indication and the additional work will not be performed without express written consent of OWNER. 2. Statements from ENGINEER to OWNER requesting progress payments shall be prepared and transmitted for payment in the manner prescribed in the Terms and Condition's below. B. The terms of compensation and other terms and conditions governing this work shall be as defined by General Engineering Services Agreement dated �, 2009. SCHEDULE ENGINEER proposes to complete the work defined herein within 10 weeks following OWNER's notice to proceed with the above described services. The adherence to this schedule is, of course, contingent on timely receipt from the OWNER of information needed by the ENGINEER to carry out this assignment, and prompt review and return of all documents submitted to OWNER by ENGINEER for comment/approval.
