ADDENDUM NO. 1 TO AMENDMENT NO. 2 TO
ENGINEERING SERVICES CONTRACT
VETERANS MEMORIAL DRIVE EXTENSION
This supplementary agreement amends the Engineering Services Contract, between
Bowen Engineering & Surveying, Inc., hereinafter referred to as the "Engineer", and the
City of Cape Girardeau, hereinafter referred to as the "City". The Engineering Services
Contract, between the City and Engineer, was approved on the 3rd day of April ,
2006 by action of the City Council's Resolution No. 2165 . This addendum is for
additional design engineering services relating to the extension of Veterans Memorial Drive.
Whereas, the City intends to extend Veterans Memorial Drive south from U.S. Highway 61
(Kingshighway) at the Missouri Veterans Home, along the east side and parallel to the
Interstate Route 55 right of way, approximately 6,200 feet to the south end of Ashland
Court Subdivision, including construction of sidewalks, installation of storm sewers, storm
water detention basins and other drainage features, and reconstruction of an existing
parking lot at the Missouri Veteran's Home and whereas the Engineer agrees to provide
additional engineering and surveying services for this Project, and to complete the work, to
the satisfaction of the City, and for the rates set forth in Attachment"A-2"of the Engineering
Services Contract. The additional engineering and surveying services shall include
preparing legal descriptions and plats for the Missouri Veterans Home property, modifying
storm sewer inlet locations, details and profiles to accommodate the new curb inlet
standards adopted by the City, and locating new and relocated highway signage along
Interstate Route 55.
The Engineer shall provide these services and develop necessary survey data and
documents as described by the City. The time from receipt of a Notice to Proceed to
completion of the necessary survey work and preparing the necessary documents for
review by the City shall not exceed a time to be agreed upon by the Engineer and the City
prior to commencement of the additional work.
If conditions outside the control of the Engineer occur, or substantial changes to the original
scope of work are required by the City, the Engineer reserves the right to extend the time of
completion in an amount to be agreed upon by the Engineer and the City.

ARTICLE I - SCOPE OF SERVICES
A. DESIGN PHASE - The Engineer will:
1. Obtain additional field survey work to determine the locations of new
and/or relocated highway signs along Interstate Route 55 and include the
location information on the project plans.
2. Prepare legal descriptions and plats for the Missouri Veterans Home
property to comply with Veterans Administration requirements. All work
is to be coordinated with the City.
3. Modify storm sewer inlet locations, details and profiles to accommodate
the new curb inlet standards adopted by the City.
The Engineer will provide these services for the hourly rates set forth in the Engineering
Services Contract Attachment "A-2". The not-to-exceed fee for the Design Phase of this
project is $6,606.03. All Articles of the Engineering Services Contract apply to this
addendum, as if fully set forth herein.
