A RESOLUTION AUTHORIZING THE CITY
MANAGER TO EXECUTE A CONTRACT WITH
J & M DISPLAYS, INC. FOR A
FIREWORKS DISPLAY
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS :
ARTICLE 1 . The City Manager, for and on behalf of the City
of Cape Girardeau, Missouri, is hereby authorized to execute a
Contract with J & M Displays, Inc . , for a fireworks display. A
copy of said Contract is attached to this Resolution and made a
part hereof .

CONTRACT FOR FIREWORKS DISPLAY
This contract entered into on this _;'iC� day of , ; « ,
2001, by and between the J & M DISPLAYS, INC. , hereinafter referred
to as "J & M" , and the CITY OF CAPE GIRARDEAU, MISSOURI,
hereinafter referred to as the "City" .
l . The parties hereto agree that J & M will provide a
fireworks display for the City on July 4, 2001, in accordance with
the requirements of the "Fireworks Display -- City of Cape
Girardeau Bid Packet -- April, 2001" , said bid documents are marked
Exhibit A and attached hereto and incorporated herein by reference
as though fully set out .
2 . The parties hereto agree that the above referenced bid
documents and J & M' s Proposal Number 705 for the sum of Fifteen
Thousand Dollars ($15, 000 . 00) , which is marked as Exhibit B and
attached hereto and incorporated herein by reference as though
fully set out, shall constitute the agreement between the parties
with respect to the production of the fireworks display on July 4 ,
2001, for the City.
3 . The parties agree that the City shall provide
compensation to J & M for the services as provided in the bid
documents and Proposal Number 705 .
4 . In accordance with the bid documents and Proposal Number
705, the City will provide a barge for J & M' s use in the show
having a minimum dimension of forty (40) feet by one hundred (100)
feet, with five (5) tons of sand on the barge. That barge will be
located at least nine hundred (900) feet from the Cape Girardeau

City shoreline during the display. J & M will provide satisfactory
proof to the City that the owners of all barges used for the
display will be named as additional insureds on J & M' s liability
insurance policy.
THIS AGREEMENT shall be binding upon the successors and
assigns of the parties .

NOTICE TO BID
The City of Cape Girardeau is seeking bids for a Fireworks Display on July 4, 2001. Bid
forms and specifications may be obtained at Cape Girardeau City Hall, 401 Independence,
or will be mailed upon request.
All questions regarding the bid packet should be directed to Nancy Poston at 573-334-
7146.
Sealed bids marked"FIREWORKS DISPLAY"must be received by 3:00 PM ,May 23,
2001 ,at Cape Girardeau City Hall at which time they will be publicly opened and
announced.
The City reserves the right to reject or accept any or all portions of all bids.

FIREWORKS DISPLAY
BID INSTRUCTIONS
1. To be considered as a complete and qualified bid all bid packets must include
the following documents:
A. The City of Cape Girardeau Bid Form for Fireworks Display.
B. Supportive of supplementary material, as requested in the attached Bid
Specifications.
C. Certificate of Insurance as required under the Bid Specifications.
2. All bids should be firm prices exclusive of all taxes and must be valid for 90 days.
3. Bidder must furnish a list of references with contact persons and telephone numbers.
4. The City reserves the right to reject or accept any or all portions of all bids.
5. Terms and conditions will be negotiated with the successful Bidder and final
contract approved by the City Council upon award of the Bid.
6. The Bidder shall not make any changes in or additions to the attached specifications
unless Bidder has received prior approval in writing by the City.
7. The bid amount shall be on the basis of a unit price for the complete display as
specified and shall include the cost of all accessories as set forth in these
specifications. Transportation, overhead, insurance and other expenses shall be
included in the total bid amount.
8. Bidder shall read thoroughly and understand the specifications in relation to the bid,
which is submitted. If the Bidder has any questions concerning the true meaning or
intent of the specifications or any of the requirements stated herein, the Bidder shall
request an interpretation in writing by 3:00 PM, May 14, 2001, and an addendum
shall be issued by the City. All addendums shall be made available to all Bidders to
whom specifications and other relevant material have been issued. Failure to
request an addendum covering any such questions shall not relieve the Bidder
from performing the work in accordance with the intent of the specifications.

9. Execution of Contractor will include penalties if show is canceled due to bidder's
default.
10. Any bid received by the City after stated opening time will not be honored by the
City. There will be NO EXCEPTIONS. Bidder shall be responsible for the actual
delivery of the bids during business hours to the address indicated. It shall not be
sufficient to show that the bid was mailed in time to be received before scheduled
closing time for receipt of bids.
11. Any bidder may withdraw or modify his bid at any time prior to the scheduled
closing time for receipt of bids. The bid, when opened, will then be corrected in
accordance with such written request,provided that the written request is contained
in a sealed envelope which is plainly marked"MODIFICATION OF BID—
FIREWORKS DISPLAY." Oral or telephone modifications or corrections will
not be recognized or considered. Request for modifications or corrections of bids
cannot be submitted after the closing time for receipt of bids.
12. All bids must be received at Cape Girardeau City Hall, 401 Independence, Cape
Girardeau, MO by 3:00 PM, May 23, 2001, at which time they will be publicly
opened and announced.

FIREWORKS DISPLAY
BID SPECIFICATIONS
I. GENERAL GUIDELINES
The City of Cape Girardeau is seeking bids for a Fireworks Display to be held on
Wednesday,July 4, 2001 at 9:00 p.m. The successful bidder is to provide all
materials, labor and set-up for a display to be fired from the Mississippi River at
Cape Girardeau on July 4,2001. (This display will be fired from a barge on the
Mississippi River or, alternatively, from the Illinois bank of the River at Cape
Girardeau.) The City of Cape Girardeau will be responsible for obtaining a barge.
Specifications are general and are not intended to exclude any potential Bidder or
supplier. All qualified bidders are encouraged to submit bids. Attached to these
specifications is Attachment 1,where Bidders should list types of fireworks,which
will be used in the Fireworks display on the Mississippi River at Cape Girardeau on
July 4, 2001. Bidders should also include a description of required barge equipment
and preferred distance from the Riverbank.
A. Location of Fireworks Displav
Mississippi River at Cape Girardeau
Wednesday,July 4 at 9 p.m.
B. Permits
Bidder will be responsible for securing all applicable permits as requested by
Cape Girardeau County,the local Fire Department and the City of Cape
Girardeau prior to the commencement of the Fireworks Display. Bidder
must provide copies of all such permits to the City of Cape Girardeau two
weeks prior to the commencement of the Fireworks Display.
C. Show
1. If the display of fireworks CANNOT be given on July 4, 2001, due
to inclement weather, the program will be given the next night or the
first following clear night as determined by the Event Director. This
change will be at no additional cost to the City.
2. For safety purposes the complete show should be electronically fired.
3. The show should be choreographed to mutually agreed upon music.
The Public Address system will be provided by the bidder.

D. Budget(Please bid on both of the following options.)
1. A budget of$10,000 will be considered for an approximate 20-
minute spectacular show.
2. A budget of$15,000 will be considered for an approximate 20-
minute spectacular show.
E. Set up and Safety Zone
1. The City Staff will meet with the awarded Bidder and have a
mutually agreed upon site for fireworks and the roping off of the
safety zone area.
2. The Bidder will provide the City with a written safety plan and/or
company procedures,which address safety issues in accordance with
state fire regulations.
3. Delivery of all fireworks,mortar tubes and mortar racks.
4. Set up shall be by qualified pyrotechnics personnel.
5. Firing by qualified pyrotechnics personnel.
6. Pick up and return of all equipment within 24 hours of actual firing
of show(9 p.m., July 5, 2001).
7. The Fireworks Company shall provide security before, during and
after the display to keep spectators and vehicles clear of firing safety
area and the fallout area.
8. The City shall provide personnel to install and take down materials
for marking the boundary of the firing safety area.
9. Any additional set-up of items requested by the Bidder/Supplier will
be considered by the City. These items must be identified in the bid
response. (i.e. need for sand, etc.)
10. Set up shall be done by 7 p.m. on July 4, 2001.
F. Clean-Un
1. The City is responsible for the clean up outside the boundary of the
firing area.
2. Bidder is responsible for clean-up and proper disposal of the
materials within the firing area.

II. INSURANCE REQUIREMENTS
Bidder shall maintain insurance coverage in the following amounts:
MINIMUM LIMITS OF LIABILITY
1. Workers Compensation/Coverage A Statutory
Employer's Liability/Coverage B $500,000
2. Commercial General Liability $2,000,000 each occurrence
Including contractual liability,bodily (Additional insurance may be required
Injury and property damage if the display is fired from a barge.)
3. Comprehensive Automobile Liability
Including bodily injury and property
damage $2,000,000 each occurrence
4. Excess Liability $2,000,000 each occurrence
The City of Cape Girardeau and a barge company designated by the City must be named as
additional insured on Bidder's General Liability, Auto and Excess Liability Coverage.
Bidder's insurance carriers must be an"A"rated company pursuant to Best Ratings.
Liability coverage shall be primary to any insurance maintained by the City of Cape
Girardeau.
Certificate of Insurance and Endorsements evidencing the above coverage shall be
filed with this bid proposal.
Such certificates shall afford the City of Cape Girardeau thirty(30) days written notice of
cancellation or material change of coverage, the City of Cape Girardeau shall have the right
to obtain the required insurance, at Bidder's expense, to the completion of the services
under this Agreement. City of Cape Girardeau reserves the right to review the actual
policies of Bidder's insurance coverage as listed above.
