HomeMy WebLinkAboutRES.1902.07-21-2003 � ADDENDUM TO ENGINEERING SERVICES CONTRACT FOR DESIGN OF THE INTERSECTION OF SILVER SPRINGS ROAD AND US HIGHWAY `61' CITY OF CAPE GIRARDEAU,MISSOURI THIS ADDENDUM TO THE EXISTING ENGINEERING SERVICES CONTRACT dated September 5th, 2001, for general engineering services for engineering projects, is between the City of Cape Girardeau, hereinafter referred to as the "City" and Koehler Engineering and Land Surveying, Inc., hereinafter referred to as the "Engineer". This addendum shall be for the purposes of obtaining design documents for the construction of a new signalized intersection of Silver Springs Road and Highway `61', located at the southern terminus of Silver Springs Road. All related demolition, new pavement construction, signal design, storm water and utility improvements shall be addressed by the design under this contract. Except as modified hereafter, all articles and provisions of the original contract shall remain in full force and effect. ARTICLE I — SCOPE OF SERVICES A specific scope of services for this contract addendum and the identified project shall be as identified below: A. PRELIMINARY DESIGN PHASE — After written authorization to proceed with the Preliminary Design the Engineer shall: 1. Assist the City in coordinating and deciding the needs and requirements of the project. 2. Conduct topographic, property and utility surveys as needed and supplement existing data and to be fully sufficient to determine the existing conditions for the project and to develop plans for the project. 3. Arrange for any subcontractor services as may be required. 4. Prepare alternate designs and cost estimates, develop preliminary plans, and recommend the best design based on these studies, develop final plans and specifications for the specific project. In addition to normal design activities, specific services to be addressed by the preliminary and final design phases are to be as indicated hereafter. a. Coordinate the project through initial schematic reviews of both the City of Cape Girardeau and the Missouri Department of Transportation. b. Provide for the preliminary design of new pavement for the intersection, new access from the frontage, and the connection from Silver Springs Road in accordance with the requirements of the City of Cape Girardeau and the Missouri Department of Transportation. c. Provide for the preliminary design of drainage improvements along the project route, as required by the design, and in accordance with the requirements of the City and the Missouri Department of Transportation. d. Provide the preliminary design of all elements of the Signalized Intersection including signal poles, mast arms, conductors, detectors (camera or loops), facings, backings, signage, etc. e. Provide the preliminary design of a Traffic Control Plan in accordance with the City of Cape Girardeau and the Missouri Department of Transportation. f. Provide the preliminary design of an Erosion Control Plan in accordance with the requirements of the Missouri Department of Natural Resources. g. Coordinate with and stake locations for geo-technical firm to perForm borings in heavy cut areas, if required. 5. Furnish finro copies of the above Preliminary Design documents to the City and the Missouri Department of Transportation. A. DESIGN PHASE —After written authorization to proceed with the Preliminary Design the Engineer shall: 1. If required, authorize a Title Company to proceed with securing adequate property title information, determine right-of-way and easements required for successful execution of the project, and provide assistance to the City in acquiring right-of-way or easements. 2. Ensure compliance with water quality and flood plain management by coordinating with the Missouri Department of Natural Resources, the U. S. Army Corps of Engineer, and other regulatory agencies as required under the scope of the project. 3. Prepare Specifications and Bid Documents for the Project, incorporating the Missouri Department of Transportation standard specifications where available, and preparing special conditions where said standards are not available. 4. Advise the City and Missouri Department of Transportation of any adjustments to the latest opinion of probable Total Project Costs caused by changes in general scope, extent or character or design requirements of the Project or Construction Costs. Furnish to City and the Missouri Department of Transportation a revised opinion of probable Total Project Costs based on the Drawings and Specifications. 5. Furnish the City and the Missouri Department of Transportation with finro approval copies of the final Contract Drawings and Bid Documents B. BIDDING PHASE —The Engineer will: 1. This project is to be Bid by the Missouri Department of Transportation. The engineer will assist as necessary to answers questions pertaining to the design, however all other aspects of the project bidding will be provided by the Missouri State Department of Transportation. C. CONSTRUCTION PHASE — (Construction Phase Services are an option to this addendum, and are to be provided for and detailed in a supplemental agreement prepared prior to construction activities, if such services are required by the City or the State). It the City or the State desires to engage the Engineer to provide construction phase services, the Engineer will serve as the City or State's representative for administering the terms of the construction Contract. The Engineer shall not authorize change orders or otherwise alter the terms of a construction Contract except with the City's or State's express written authorization. The Engineer will attempt to protect the City and State against defects and deficiencies in workmanship and materials. However, providing project representation shall not make the Engineer responsible for construction methods or procedures used by the Contractor, nor for the Contractor's failure to perForm work according to the Contract documents. More specifically, the Engineer's services will include the following. 1. Assist the City or State with a pre-construction conference to discuss project details with the Contractor. 2. Make periodic site visits to observe the Contractor's progress and quality of work, and determine if the work conforms to the Contract Documents. Provide construction surveys and construction staking as required by the Contractor. The Engineer will accompany the City's or States representatives on visits to the project as requested. 3. Check shop drawings, review construction schedules and drawings submitted by the Contractor. 4. Reject work not conforming to the project documents. 5. Prepare change orders for issuance by the City or State as necessary to assure that proper approvals are made before performance of work. 6. Review wage rates, postings, equal employment opportunity requirements and other related items called for in the Contract. 7. Inspect materials, review material certifications furnished by Contractor, sample concrete and other materials, and if required, arrange for laboratory testing of samples by others on a subcontractor basis. 8. Maintain project records, construction diary and other project information, measurements of quantities, and review monthly estimates for payments due the Contractor. Estimates are to be submitted to the Engineer by the 10t" of the month so that the Engineer can make their review to the City on or before the 15th of the same month. 9. Be present during critical construction operations. 10.Participate in final inspection, and provide the City and State with project documentation diaries, test results, certifications, etc., also provide record plans for the City's and State's records if requested. ARTICLE II — PERIOD OF SERVICE The Engineer will commence work required by the addendum within 10 days after receiving notice to proceed from the City. The addendum work shall be completed in accordance with the following schedule: A. Preliminary Plans shall be completed for review by city staff — Within 90 calendar days after receipt of notice to proceed. B. Final Plans shall be revised and Completed within 60 calendar days after completion of review of preliminary plans by City. C. Easement plats and documents completed — Within 30 calendar days of completion of review of preliminary plans by City. D. The period of service for construction phase services will be detailed in a supplemental agreement, if required. The above times are exclusive of review time by other agencies and exclusive of time needed to acquire right-of-way. The City will grant time extensions for unavoidable delays beyond the control of the Engineer. Requests for extensions of time shall be requested in writing by the Engineer, stating fully the reasons for the request. ARTICLE III — STANDARDS For services provided under this addendum, the City will compensate the Engineer as follows: A. For design services, including work through the completion of the final design plans and specifications, the City will reimburse the Engineer for the hours expended and at the hourly rates set forth in Attachment "A" of the original contract. For the basic design services set forth in this addendum, reimbursement to the Engineer shall not exceed $ 38,390 (Thirty-Eiqht Thousand, Three Hundred Ninety Dollars) which sum includes the desiqn services for the Intersection of Silver Sprinqs Road and US Hiqhway `61', as detailed herein. B. Reimbursable expenses under this contract not included with the above maximum fee are detailed on Attachment `B': ARTICLE IV This addendum is made and entered into subject to the approval of the City of Cape Girardeau. Attachment `B' Contract Reimbursable Items 1. Travel, subsistence, and incidental cost. 2. Use of motor vehicles on a mileage basis of 0.32 (excluding vehicular travel within the Cape Girardeau County). 3. Long distance telephone cost and project "on site" telephone cost. 4. Reproduction of reports, drawings, specifications, and other project related documents. 5. Postage and shipping charges for project related materials. 6. Rental charges for use of equipment not owned by Koehler Engineering & Land Surveying, Inc. (if required). 7. Cost of acquiring other materials or services specifically for and applicable to this project. 8. Subcontract cost including those for soils and geotechnical investigations and reports, title insurance company research and reports, testing and laboratory services (if performed by others), and other subcontract services. 9. Charges of special consultants requested or authorized by the City. 10. Special insurance coverage required by the City, including the cost of naming the City as an additional insured. (if in excess of current overages, included in the appendix. 11. Local taxes or fees applicable to the work or payments therefore. 12. Charges for review of drawings and specifications by governmental agencies, if any.
