A RESOLUTION AUTAORIZING THE CHIEF OF POLICE TO
ENTER INTO A SOUTHEAST MISSOIIRI
MQLTI-JURISDICTIONAL DRUG TASK FORCE INTERAGENCY
AGREEMENT WITH THE MISSOURI STATE HIGHWAY PATROL

MISSOURI, AS FOLLOWS:
ARTICLE 1 . The Chief of Police, for and on behalf of the City
of Cape Girardeau, Missouri , is hereby authorized to enter in�o a
Southeast Missouri Multi-Jurisdictional Drug Task Force Interagency
Agreement with the Missouri State Highway Patrol . A copy of said
Agreement is attac.hed to this Resolution and made a part hereof .

MULTI-JURISDICTIONAL DRUG TASK FORCE
. INTERAGENCY AGREEMENT
The undersigned Iaw enforcement agencies do now enter into this interagency
agreement to create a multi-jurisdictional drug task force in order to provide
� to the public more effective law enforcement protection against those who
engage in this trafficking of narcotics and dangerous drugs.
The undersigned parties agree to the following:
I: PARTIES. Parties to this agreement are: Missouri State Highway Patrol,
(NOTE: The Task Force shall not be restricted to the jurisdictions
represented by these parties) .
II. BOARD OF DIRECTORS. The Task Force Board of Directors is elected by
and will represent the participating parties to this agceement. The
Board of Directors is comprised of a President, Vice President,
Secretary, and four other board members. The Board of Directors will be
res�onsible for the implementation and conduct of the terms of this
agreement on behalf of the participating parties.
III. DUTIES OF THE TA�K FORCE_ The primary duties of the Task Force
consist of the following:
A. To conduct covert and overt narcotics investigations on individuals
and organizations engaged in drug-related activities.
B. To establish liaison with the respective state and federal prosecutors
for legal advice and encouragement of vigorous prosecutian of Task
Force Investigations.
C. To develop and maintain an intelligence data base on the trafficking
of narcotics and dangerous drugs and other related criminal
activitie�.
D. 7o establish liaison with local, state, and fedet�al law enforcement
agencies in Southeast Missouri ta better coordinal:e drug
investigations and disseminate dsug-related intel:ligence.
IV. LIABILITIES AND INSURANCE. The parties understand th;3t personnel
appointed to the Southeast Missouri Task Force remain employees of
their respective departments and th�t those departm�nts agree to
supply necessary equipme�t items, and to c�mpensate their officer(s)
for personal services randered in support of Task Force operations.
Such compensatian shall include, but is not limited to, cost oP wages,
overtime, liability insurance, workmens compensation, injury, death,
and retirement benefits.

(NOTE: The member's salary may be reimbursible to their respective
department at the discretion of the Board of Directors) .
V. DUTIES OF THE MISSOURI STATE HIGHWAY PATROL.
� The Missouri State ighway Patrol agrees to supply the following: -
A. A trained narcotics investigator to act as coordinator of the Task
Force.
B. Informal attachment of any other Missouri State Highway Patrol
Narcotics Investigator(s) permanently assigned to the Troop E
area to the Task Force.
(NOTE: A Missouri State Highway Patrol Narcotics Investigator may be
temporarily assigned to other investigations at the discretion of
his/her supervisor) .
C. Funds to be utilized solely for the purchase of n�3rcotics and �
dangerous drugs or, for confidential informant ex��ense and/or
informant salary.
D. Any other facilities/equipment/services/manpower deemed appropriate
by the Director of Division of Drug and Crime Control.
E. The Missouri State Highway Patrol agrees to relinquish all claims on
�seized moneys and properties that are forfeited through Missouri's
Criminal Activity Forfeiture Act, Chapter 513, RSMa, and as a direct
result of a Task Force investigation.

D. A Cash reserve from forfeited money or properties seized or acquired
as a result of Task Force Investigations.
1. . Forfeited money and property seized during the first year will
all go to the cash reserve.
2. . Forfeited money and property seized each year thereafter shall
be allowed to accumulate in the cash reserve to twice the previous
� years total Task Force expenditures, not including buy money
' . provided by the Missouri State Highway Patrol. Any balance over
this amount shall be distributed among the participating parties
at the discretion of the Board of Directors; although, a party's
contributions to the task force shall be considered and all
participating parties shall receive a share in the distribution
process.
3. Restitution moneys set aside by the courts for the specific
purpose of replenishing buy moneys shall be returned to the
Missouri State Highway Patrol State Investigative Fund.
. VII. OPERATIONAL PROCEDURES. The parties agree that the following
operational procedures shall prevail throughout the duration of this
agreementc
A. Task Force Coordinator:
7 . Will have full tactical control of day to day operations of the
Task Force. He shall be a member of the Missouri State Highway
Patrol and assigned to the Narcotics Section of the Division cf
Drug and Crime Control. He shall be appointe�d by the Director of
. Division of Drug and Crime Control with the a�proval of the Task
Force Board of Directors.
2. Wi11 be responsible for narcotics related training of Task Force
Members and will devise and implement apprapriate training for
the members.
3. Will be responsible for the approval of all officer expense
(travel, meals, etc. ) and buy moneys expended by Task Force
Members. He shall review and document all such expenditures
in accordance with Missouri State Highway Patrol Nascotics
Section "Standard Operational Procedure."
4. Will be responsible for overtime approval, timekeeping
responsibilities and submission of inembers time tabulations to
their respective agencies.
5. Will be responsible for providing information to the Board of
' Directors related to Task Force Expenditures and activities.
Activity reports shall not be specific in nature.

B.� Task Force Members:
1 . Will be selected and empowered by the Board of Directors after
interviews, background investigations (when appropriate) and ,
recommendations by a Board comprised of the Task Force
Coordinator, another Missouri State Highway Patrol Narcotics
Investigator and a narcotics investigator from outside the
Missouri State Highway Patrol. The Missouri State Highway
Patrol reserves the right to refuse a potential Task Force member.
2. Will be a full-time police officer of a local agency and, prior
to appointment, have been afforded appropriate training as required
by law. Non-Missouri State Highway Patrol Task Force Members shall
possess a commission by one or more officially recognized law
enforcement agencies. Their commission(s) shall provide the
mer�;�er with legal authority to enforce drug trafficking statutes on
a multi-jurisdictional basis. He shall be solely directed and
supervised by the Task Force Coordinatdr.
3. Will adhere to all laws of the State of Missouri and the United
States of America.
- 4. Will maintain compliance with the respective agencys policies
and procedures as well as the policies and procedures of the
Missouri State Highway Patrol. In the event of conflict, the
most rigid standard will be adhered to.
5. Will not consume intoxicating beveragr:�s while on duty except in
the performance of duty, and in those instances, never to the extent
that the officers ability to perform an official assignment or
function is impaired.
6. Will request annual leave to the Task Force Coordinator wha shall
coordinate the request with their respective agency.
7. Will report to the Task Force Coard.inator or his designee as soon
as possible, any incident, accident, or conduct by the Task Force
member, that might reflect unfavorably upon any party to khis
agreement (NOTE: Yialation of these Task Force policies and
procedures by a Task Force member shall be sufficient grounds for
dismissal from the Task Force by the Board of Directors.
VIII. OTHER OPERATI�NA� CONSIDERATIONS.
A. Report Writing - Missouri State Highway Patrol report writing and
case preparation procedures, and documentation of officers
expenditures, shall be utilized by the Task Force Members.

B. Confidential Sources - Missouri State Highway Patrol confidential
- informant documentation, handling procedures, and payments procedures�
shall be utilized by the Task Force Members.
C. The local authority in whose jurisdiction the Task force is
Operating shall be notified when possible and, when appropriate,
shall participate in the operation. This provision may be waived
if exigent circumstances do not permit notification and/or
participation, or if the Task Force Coordinator believes an unusual
circumstance makes the notification or participation unwise.
D. All equipment provided to the Task Force by participating
parties, other than Missouri State Highway Patrol equipment, shall
become property of the Task Force until such t:ime as:
1 . The Task Force is disbanded,
2. The donating party withdraws from the Task Force or,
3. The donating party formally requests the return of the
equipment, •
at such times the party's equipment shall be returned within 10
working days and the transfer shall be documented. Borrowing of
Task Force equipment shail be discauraged and only with the consent
of the Task Force Coordinator or his designee.
IX. TERMINATI�N/MODIFICATION OF AGREEMENT.
Any party may withdraw from this agreement thirty days after providing
written notice of withdrawal to all other parties. Withdrawal of any
party will not affect the agreement with respect to the remaining
parties. Any modification of this agreement requires written approval
by all parties.

The Cape Girardeau Police Department asks for a City
Council Resolution supporting the Police Department ' s partici-
pation in the newly formed Southeast Missouri Multi-
Jurisdictional Drug Task Force recently formed to provide to the
public more effective law enforcement protection against those
who engage in trafficking of narcotics and dangerous drugs, The
Task Force consists of thirteen Southeast Missouri counties,
including sheriff ' s departments and municipal law enforcement
agencies on a grant provided by the Missouri Department of Pub-
lic Safety.

SPECIAL TASK FORCE AGREEMENT
This doc�nent is to represent an agreement and request frcan all of the
undersigned law enforcement agencies to participate in IDICT (Eighth Drug
Intervention & Control Task Force) . It is acknowledged that each agency as
listed is a participant of IDICT and is not bound to any r�nuneration or
resource c�unitrnent but is willing to participate in the IDICT program. It
is further noted that on some future date the undersigned may be asked to
ccxrmit funds or personr.el to IDICT, but at the point of this writing the
undersigned is now only commiting to agency support for the concept of IDICT.
