WITNESSETH, that for and in consideration of the acceptance of the CONTRACTOR' S bid in the amount of Fourteen Thousand Seven Hundred Forty Dollars ($14, 740 . 00) and the award of this contract to said CONTRACTOR by the OWNER and in full consideration of the agreements of the parties herein contained, to be well and truly observed and faithfully kept by them and each of them, it is agreed between the parties as follows, to- wit . The OWNER and CONTRACTOR in consideration of the mutual covenants hereinafter set forth, agree as follows : ARTICLE I . WORK. The CONTRACTOR shall complete all work as specified or indicated in the Contract Documents . The Work is generally described as follows : The relocation of the Federal Aviation Administration Airways Facility Sector Office Storage Area at the Cape Girardeau Regional Airport, and other associated work as shown on the Request for Proposal, Bid No. I001326, dated October 17, 2001, This work is for the City of Cape Girardeau, Missouri . ARTICLE II. CONTR.ACT TIME. The work will be substantially completed on or before November 19, 2001 . ARTICLE III. CONTRACT PRICE. The OWNER shall pay the CONTRACTOR upon completion of the work in accordance with the Contract Documents the sum of Fourteen Thousand Seven Hundred Forty Dollars ($14, 740 . 00) . ARTICLE IV. PAYMENT PROCEDURES. The CONTRACTOR shall submit an application for payment upon completion of the work. This application for payment will be processed by the Airport Manager. ARTICLE V. CONTR.ACTOR' S REPRESENTATIONS. In order to induce the OWNER to enter into this Agreement, CONTRACTOR makes the following representations : 5 . 1 CONTRACTOR has examined and carefully studied the Contract Document (including all Addenda) and other related data identified in the Bidding Documents, including any "technical data" that CONTRACTOR may deem appropriate . 5 . 2 CONTRACTOR has visited the site and become familiar with and is satisfied regarding the general , local, site conditions that may affect cost, progress, performance and furnishing of the Work. 5 . 3 CONTRACTOR is familiar with and is satisfied regarding federal , state, local laws and/or other regulations that may affect cost, progress, performance and furnishing of the Work. 5 .4 CONTRACTOR has carefully studied all reports of explorations and tests of subsurface conditions at or contiguous to the site and all drawings of physical conditions in or relating to existing surface or subsurface structures at or contiguous to the site that CONTRACTOR deems appropriate. The CONTRACTOR acknowledges that plans, specifications and/or reports may not be complete for CONTRACTOR' S purposes . The CONTRACTOR acknowledges that OWNER does not assume responsibility for the accuracy or completeness of information and data shown in or indicated in the Contract Documents with respect to any underground facilities at or contiguous to the site. The CONTRACTOR has obtained and carefully studied (or assumes responsibility for having done so) all such additional 2 supplementary examinations, investigations, explorations, tests, studies and data concerning conditions (surface, subsurface and underground facilities) at or contiguous to the site or otherwise which may affect cost, progress, performance or furnishing of the work or which relate to any aspect of the means, methods, techniques, sequences and procedures of construction to be employed by CONTR.ACTOR and safety precautions and programs incident thereto. The CONTRACTOR does not consider that any additional examinations, investigations, explorations, tests, studies or data are necessary for the performance and furnishing of the work at the contract price, within the contract time and in accordance with the other terms and conditions of the Contract Documents . 5 . 5 CONTRACTOR is aware of the general nature of work to be performed by OWNERS and others at the site that relates to the work as indicated in the Contract Documents. 5 . 6 CONTRACTOR has correlated the information known to CONTRACTOR, information and observation obtained from visits to the site, reports and drawings identified in the Contract Documents and all additional examinations, investigations, explorations, tests, studies and data with the Contract Documents . 5 . 7 CONTR.ACTOR has given OWNER written notice of all conflicts, errors, ambiguities or discrepancies that CONTR.ACTOR has discovered in the Contract Documents and any written resolution thereof by OWNER is acceptable to CONTRACTOR, and the Contract Documents are generally sufficient to indicate and convey understanding of all terms and conditions for performance and furnishing of the work. ARTICLE VI . CONTR.ACT DOCUMENTS. The Contract Documents which comprise the entire agreement between OWNER and CONTRACTOR concerning the work consist of the following: Request for Proposal , Bid No. I001326, dated October 17, 2001, including instructions and general conditions for bidders, instructions, terms and conditions, specifications and requirements, proposal return sheet, annual wage order No. 8, dated March 9, 2001, the completed proposal return sheet from Nip Kelley Equipment Co. , Inc . and all other documents and diagrams contained in said Request for Proposal . Al1 insurance 3 policies obtained pursuant to this Agreement, and any performance, payment, or other bonds obtained by the CONTRACTOR for this work are also included as part of the Contract Documents . There are no Contract Documents other than those listed in this Article . The Contract Documents may only be amended, modified or supplemented by written approval of both parties . Copies of all of these documents are attached to this Agreement and incorporated herein by reference. ARTICLE VII. Bidders are encouraged to view the existing and proposed sights before placing bid. 3. PaYt B: Specifications � Requirements General Specifications 1. Successful bidder must be able to have work completed on or before November 19,2001. 2. Successful bidder will need to have a pre-construction meeting with the City of Cape Girardeau and the FAA prior to the starting of the project. . i . , , Foundation Specifications 1. Successful bidder shall be responsible for locating all underground utilities and preparing sight for installation of gravel. 2. Successful bidder shall be responsible for preparing ground service for all gravel,concrete and foundation work to meet specifications. 3. Buildings#1 and#3 shall have 12"wide by 18"depth footing placed under skid. 4. Building#2 without skid shall have a 12"wide by 18"depth footing around base of the building. 5. The proposed sight shall have compacted 6"gravel surface with 1"minus. Chain Link Fence 1. Bidder shall supply a 6' chain link fence—nine gauge. 2. Chain link fence shall be 2' off of property line(see diagram for dimensions). 3. Fence shall have three strands of barbwire on top. Electrical 1. Successful bidder shall run electric from power source(shown on diagram)to all three building locations. Power to each building wil(be 110/220— 100 amps. 2. Building#2 and Building#3 will have power run underground. 3. Building#1 will have power run overhead. 4. All three buildings will need'/."x 10' ground rod. All connections to ground rods must be cad welded. 5. Electric will go underground to existing panel in the building. 6. All wiring must meet all state and local codes. Security Gate 1. Successful bidder shall supply a double-swing security gate,as per attached drawing. 2. Each section of gate shall be 6ft—with a total of 12'. 3. Gate shall be supplied with a corner post for support. 4. Gate shall be supplied with a security rod to secure sections together and lock. . . If an Employer isworking ten(10) hour days and loses a day due to inclement weather, he may work ten(10) hours Friday at straight time. NO. 55: Means the regular work day shall be eight (8) hours between 6:00 a.m. and 430 p_m. When circumstances warrant, the Employer may change the regular workweek to four (4) ten-hour days at the regular time rate of pay. It being understood that all other pertinent information must be adjusted accordingly. All time worked before and after the established workday of eight (8) hours, Monday through Friday, all time worked on Saturday, shall be paid at the rate of time and one-half(1 '/�) except in cases where work is part of an employee's regular Friday shift. NO. 75: Means forty (40) hours of work consisting of five (5) days of not more than eight (8) hours per day from Monday through Friday shall constitute a work week. Double time to start at 12:00 o'clock midnight on Friday and end at 12:00 o'clock midnight on Sunday. 1�I0. 81: Means a workday of eight (8) hours, beginning at 8:00 a.m., Monday through Friday shall constitute a forty (40) hour work week. All time over the eight (8) hour day as above defined and all hours worked on Saturday shall be paid at the rate of one and one-half(1'/z) the regular rate of wages. If workmen are required to work the recognized holidays or days observed as such, or on Sunday, they shall receive double(2) the regular rate of pay for such work. NO. 82: Means a Work Day/Work Week is an Eight Hour Day/Forty Hour Week. A work day/work week shall consist of eight (8) hours a day between 7:00 a.m. and 4:30 p.m. Forty (40) hours will constitute a work week from Monday through Friday. Hours worked before or after theses hours should be paid at the appropriate overtime rate of pay. Between the hours of 7:00 a.m. and 630 p.m., Monday through Friday, up to two (2) hours per day shall be paid at the rate of one and one-half(1%) times the hourly rate for overtime work. NO. 86: Means the regular work week shall consist of five (S) days, Monday through Friday, beginning at 8:00 a.m. and ending at 4:30 p.m. The regular work day beginning time may be advanced one or two hours or delayed by one hour_ All overtime work performed on Monday through Saturday shall be paid � at time and one-half(1`/�) of the hourly rate plus an amount equal to one-lialf(`/�) of the hourly Total Indicated Fringe Benefits. CAPE G[RARDEAU COUNTY OVERTIME RATES -BUILDING CONSCRUCTION NO. 89: Means the nocmal workweek shall consist of five(5) eight(8) hour days for a total of forty (40) hours, starting on Monday at 8:00 a.m. and ending on Friday at 4:30 p.m. The starting time can be flexible between 6:00 a.m. and 8:00 a.m. and ending at 2:30 p.m. or 4:30 p.m. respectively. All work before designated starting time and after quitting time shall be paid for at the rate of time and one-half (1'/2) . An overtime rate of time and one-half(1%2) the base hourly rate shall be paid on all hours in excess of eight(8) hours in a day Monday through Friday. Saturdays, Sundays and Holidays shall be paid for at the rate of double (2) time. Any work started after 12:00 midnight Sunday, will be classified as time and one-half(1'/z) up to the legal starting time on Monday. IVO. 90: Means eight(8) hours shal( constitute a day's work between the hours of 7:00 a.m. to 5:00 p.m. from Monday to Priday, inclusive. The work week shall be forty (40) hours, Monday through Friday. Any work in excess of forty (40) hours in one week shall be paid at the applicable overtime rate. At the Employer's option the work week can consist of five (5) eight (8) hour days or four (4) ten (10) hour days. In case of bad weather, or equipment breakdown, Friday may be used as a mak�up day if four tens are being worked. If five eights are being worked, Saturday may be used as a make-up day. If the Emp(oyer works five eight hour days, all time over eight hours in one day witl be paid at the overtffne rate. If the Employer works four ten hour days, all time over ten hours per day will be paid at the overtime rate. Time and one-half(1%z) shall be paid for the first two (2) hours of overtime work on any regular work day and any work performed before regular starting time and after regular quitting time and for the first ten (10) hours on Saturday. If the make-up day is a holiday, the employee shall be paid at the double (2) time rate.
