The City Manager, for and on behalf of the City of Cape Girardeau, Missouri, is hereby authorized to execute Amendment No. 1 to the Agreement for Professional Services with Mitchell B. Malone for drawings and specifications for a prototype toilet, pavilion and maintenance facility for future park development, in the City of Cape Girardeau, Missouri . After much consideration,this office will provide the necessary drawings and specifications to the Parks and Recreation Department for a flat fee of$15,535.00. The architectural and engineering fees for the proposed structure will include but not be limited to: 1. Architectural drawings and specifications. 2. Structural drawings and specifications. 3. MEP drawings and specifications. 4. Site Plan with an Owner supplied survey. This is a code requirement that all construction be site specific (IBC 2003-106.2). I talked to Mr. Morgan at Inspection Services on 03-15-11 and he informed me that the City of Cape Girardeau Inspection Services will inform Parks and Recreation Deparkment if site adaptation drawings are warranted. 5. Re-use fees are $1,500.00 for each structure plus hourly fees by the architect and engineers for site specific adaptations. These fees should be minimal depending on handicap accessibility issues and services(electrical and plumbing connections)up to the new structure unless site specific drawings are waived by Inspection Services per Item#4. If waived by Item#4, only the re-use fee will apply. Respectfully You , /�(��%'��-- � Mitchell Blake Malone(Architect) 2of2 4 v ♦ Amendment No 1 to the Professional Services Agreement Between Mitchell Blake Malone, Architect and the City of Cape Girardeau dated July 21, 2009 This supplementary agreement amends the professional Services Agreement between Mitchell Blake Malone, Architect, hereinafter referred to as "ArchitectfEngineer" and the City of Cape Girardeau, hereinafter referred to as the "City". The Professional Services Contract between the City and the Architect/Engineer was approved on the 22"a day of July 2009 by action of the City Council's Resolution No. 2380. This amendment is of professional services relating to the City's plan for a Prototype Public Toilet, Pavilion and Maintenance Facility Structure. Whereas the City intends to construct these facilities, it will require the establishment of a scope and a budget for the said prototype facility, and whereas the City will then esta.blish needs and the funding level for the prototype. The Architect/ Engineer agrees to provide the architectural and engineering services for the fees and provisions of the revisions to the existing Agreement as enumerated below: The Architect/Engineer shall develop Schematics, Design Development and Construction drawings with Specifications as well as an estimated construction cost for immediate and future implementation. The time from the Notice to Proceed to completion shall not exceed a time agreed upon by the Architect/Engineer and the City prior to project commencement. If conditions outside of the control of the Architect/Engineer occur, or substantial changes to the original scope of work required by the city, the Architect/Engineer reserves the right to extend the time of the completion in an amount to be agreed by the architect/Engineer and the City. The specific amendments to the existing Agreement are as follows: Exhibit B- Article B.8.3 — Fee Basis for Authorized Additional Service Fee for the additional Service for a Prototype Public Toilet, Maintenance Shed and Pavilion: The total fee for the design and construction drawings shall be $15,535.00. This additional fee will bring the total contract amount under this Agreement to $114,235.00 including normal expenses. Exhibit B—Article B.9.2 —Additional Services Professional Services—Prototype Public Toilet, Maintenance Shed and Pavilion Structure: Mitchell Blake Malone, Architect shall provide Schematic Design, Design Development, Construction Drawings and Specifications related to the City's request for a Prototype Public Toilet, Maintenance Facility and Pavilion.
