A RESOLUTION AUTHORIZING THE CITY
MANAGER TO EXECUTE AN ADDENDUM TO
AGREEMENT FOR ENGINEERING SERVICES
WITH STRICKLAND ENGINEERING, FOR
THE INDEPENDENCE STREET
RECONSTRUCTION FROM PACIFIC STREET
TO SPRIGG STREET
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Manager, for and on behalf of the City
of Cape Girardeau, Missouri, is hereby authorized to execute an
Addendum to Agreement for Engineering Services dated November 16,
1999, with Strickland Engineering for the Independence Street
Reconstruction from Pacific Street to Sprigg Street. A copy of
said Addendum is attached to this Resolution and made a part
hereof.

PROJECT SCOPE OF ENGINEERING SERVICES
INDEPENDENCE STREET RECONSTRUCTION
FROM
PACIFIC STREET TO SPRIGG STREET
THIS SC PEjOF ENGINEERING SERVICES for the Project described below is agreed to as of
/ eO between the City of Cape Girardeau, Missouri, hereinafter
referred to as the CITY and Strickland Engineering, 626 West Main Street, Jackson, Missouri 63755,
hereinafter referred to as the ENGINEER.
THIS SCOPE OF ENGINEERING SERVICES is an addendum to the AGREEMENT FOR ENGINEERING
SERVICES between the CITY and ENGINEER dated November 16, 1999.
The Project is generally described as follows: Independence Street Reconstruction from Pacific Street to
Sprigg Street.
L SCOPE OF ENGINEERING SERVICES
The scope of engineering services to be provided by the ENGINEER for the Project is as described below:
The ENGINEER proposes to provide the engineering services required for the reconstruction of the existing
pavement. The length of the project will be approximately 940 feet from the intersection of Pacific Street to
Sprigg Street. Stormwater drainage, sidewalks, and reconstruction of the existing intersections at Pacific and
Sprigg Streets will also be part of the Project.
The engineering services shall include design phase services, limited right-of-way and easement acquisition
assistance, and limited bid phase assistance. These services are further described below:
A. Design Phase
1. General. The ENGINEER shall consult with the CITY in an informal meeting to clarify and define
the requirements for the project, in particular:
a) Typical pavement cross-section & thickness
b) Stormwater drainage
c) Sidewalk reconstruction
d) Intersection reconstructions at Pacific and Sprigg Streets
2. Standards. The design of the Project will conform to the Standard Specifications of the City of Cape
Girardeau. The ENGINEER shall prepare additional specifications, if required, to define the work more
fully. Such specifications will be based on other generally accepted standards such as the latest version of
the Missouri Standard Specifications for Highway Construction.
3. Field Surveys. The Engineer shall provide the services of a Missouri Registered Land Surveyor to
perform the following:
a) Conduct engineering survey to gather topographic and utility information for design of the Project
b) Locate existing street right-of-way, property lines, and easements along route alignment
c) All surveys based upon USGS vertical datum and State Plane Coordinates
d) Establish horizontal and vertical controls sufficient for construction of the project
4. Bid Documents. The ENGINEER shall prepare documents for the purpose of obtaining competitive bids
for construction by private contractors. The bid documents shall contain the following:
a) Notice to Bid

b) Instruction to Bidders
c) Standard Form of Agreement between Owner and Contractor
d) Missouri Prevailing Wage Rate
e) Standard General Conditions of the Construction Contract
f) Supplementary Conditions
g) Construction Plans. The engineering plans will be prepared at a scale suitable to clearly show the
work to be performed. Plan and profile views of the proposed alignment will show the location and
grades of the proposed improvements. Additional drawings will be provided to show details of
intersections, drainage structures, traffic signals and other items specific to the project. Standard
construction plans from the City of Cape Girardeau and Missouri Department of Transportation will
be will be used, where applicable.
h) Construction Specifications. Construction of the Project will conform to the Standard Specifications
of the City of Cape Girardeau. The Engineer shall prepare additional specifications, if required, to
define the work more fully. Such specifications will be based on other generally accepted standards
such as the latest version of the Missouri Standard Specifications for Highway Construction.
B. Right -of -Way and Easement Acquisition
1. The ENGINEER shall provide the services of a Missouri Registered Land Surveyor to perform the
following:
a) Secure adequate property title information
b) Prepare plats and legal descriptions for obtaining right-of-way and easements
C. Bidding Phase
1. The ENGINEER shall make final corrections to the contract documents upon receiving written review
comments and construction authorization from the CITY.
2. The ENGINEER shall coordinate bid letting date, time, and place with CITY and prepare final Notice to
Bid.
3. The ENGINEER shall provide the CITY with reproducibles of the project manual and construction plans
and an estimate of construction cost for the purpose of soliciting bids from prospective bidders.
4. The ENGINEER shall interpret construction drawings and specifications; provide written responses to
questions from bidders requiring clarification; and prepare for the CITY to issue addenda to the bid
documents when required.
5. The ENGINEER shall assist the CITY in evaluating the bids and awarding a construction contract.
D. Construction Phase
The ENGINEER, if requested by the CITY, shall serve as the CITY'S representative for administering the
construction contract between the CITY and their CONTRACTOR. The scope of construction phase services
shall be determined at that time.
II. ADDITIONAL SERVICES
The CITY reserves the right to request additional work, if changed or unforeseen conditions occur beyond the
scope of this agreement. In this event, a supplement to this agreement shall be executed prior to performing
additional work or incurring any additional cost thereof. Any change in compensation will be covered in the
supplemental agreement.

III. RESPONSIBILITIES OF THE CITY
The CITY shall cooperate fully with the ENGINEER in the development of the project, including the
following:
A. Make available all information pertaining to the Project, which may be in the possession of the CITY.
B. Provide the ENGINEER with the CITY'S requirements for the PROJECT.
C. Designate a person in the CITY'S employ to act as CITY'S representative under this agreement. Said
person shall have the authority to transmit instructions, interpret the CITY'S policies, and render decisions
with respect to matters covered by this agreement.
D. Perform appraisals and appraisal review, negotiate with the property owners, and otherwise provide all
services in connection with acquiring right-of-way and easements needed to construct the project, except as
provided in Section II.B.
E. Reproduce and distribute bid documents to prospective bidders during the bid period.
IV. FEES FOR ENGINEERING SERVICES
The CITY shall reimburse the ENGINEER for the hours expended based upon the schedule of rates in
Attachment A. For the services contained herein, reimbursement to the ENGINEER shall not exceed
$26,600.00. Construction phase services are not included in this fee.
V. SCHEDULE FOR PROVIDING ENGINEERING SERVICES
The ENGINEER shall commence work within 2 weeks after receiving written notice to proceed from the
CITY. The general phases of work shall be completed in accordance with the following schedule:
A. Preliminary Design Phase - Within 75 calendar days after written receipt of notice to proceed.
B. Final Design Phase - Within 45 calendar days after written review of preliminary plans by CITY.
The above times are exclusive of review time by other agencies and exclusive of time needed to acquire
right-of-way and easements. The CITY shall grant time extensions for unavoidable delays beyond the
control of the ENGINEER. Requests for extensions of time shall be in writing by the ENGINEER, stating
fully the reasons for the request.
