Q14 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO. 9 TO THE GENERAL AGREEMENT FOR ENGINEERING SERVICES BETWEEN THE CITY OF CAPE GIRARDEAU AND S. H. SMITH & COMPANY, INC., FOR IMPROVEMENTS TO WALNUT STREET, IN THE CITY OF CAPE GIRARDEAU, MISSOURI BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1. The City Manager, for and on behalf of the City of Cape Girardeau, Missouri, is hereby authorized to execute Amendment No. 9 to the Engineering Services Contract between the City of Cape Girardeau and S. H. Smith & Company, Inc., for improvements to Walnut Street, in the City of Cape Girardeau, Missouri. A copy of said Amendment is attached to this Resolution and made a part hereof. Smith&Co. and The City of Cape Girardeau, Missouri Master Agreement executed on March 4, 2004 AMENDMENT NO. 9 This Amendment modifies and amends the General Agreement for Engineering Services dated March 4, 2004 between The City of Cape Girardeau, hereinafter referred to as the "City" and S.H. Smith& Co., Inc., hereinafter referred to as "Engineer". This amendment shall be for the purpose of performing st preliminary layout of Walnut Street from Beaudean Sti consists of collection of existing field data, preparing a stakeout of the proposed center line and right of way. SECTION I: SCOPE OF WORK d. The project generally proposed center line, and GENERAL: For all phases of survey and design, the Engineer shall submit detailed design progress reports with each application for payment. Engineer shall: TASK A — Preliminary Layout: 1. Collect existing field data to assist in determining the most suitable alignment. 2. Prepare a proposed alignment and submit it to the city engineer's office for review and approval. 3. Appoint a licensed professional engineer to serve as Project Engineer. 4. After approval of the proposed alignment by the City, we will stakeout the new alignment and sixty foot right of way line at 100 foot stationing along the centerline. 5. Attend City Council meetings and/or Public Hearings as required by CITY to provide project information to City Council and answer questions relating to proposed improvements. The estimated design cost includes attendance at one City Council/Public Hearing meetings. SECTION II: SCHEDULE The Engineer will commence work within 3 business days after receiving written Notice to Proceed. The time to complete Task A — Collection of the field data and the preliminary layout shall be completed within 21 days from Notice to Proceed. The proposed centerline layout shall be staked out within 14 days from the approval of the proposed alignment by the city engineer's office. SECTION III — COMPENSATION The Basis of Payment of this Amendment shall be TIME AND MATERIALS at the rates established in Exhibit I to this Amendment. Using the procedures set forth in Section E of the Agreement, and for the scope of services outlined in Section I of this Amendment, CITY shall pay ENGINEER as follows: 1. An amount equal to the actual hours charged to the Project by each class of Engineer's employees times the standard hourly rates in Exhibit I for each applicable billing class for all services performed on the Project. 2. Actual direct reimbursable expenses incurred plus 15% of the actual expense. Reimbursable expenses are not expected to exceed $620 on this project. 3. Mileage at a rate of $0.40 per mile. 4. The total compensation for services and reimbursable expenses for each Task is estimated to be as summarized in the following table. ENGINEER shall not exceed the amounts shown for each task without prior written by OWNER'S authorized representative. Task A Preliminary Layout $5,500 Total Not To Exceed $5,500 5. ENGINEER shall not begin any work nor obligate CITY for any fee prior to the date of WRITTEN NOTICE TO PROCEED by CITY. 6. ENGINEER shall issue monthly statements during the course of the work, based on the actual hours charged to the Project during the month. CITY shall pay undisputed portions of the invoice within 30 days after the date of the invoice.
