WHEREAS, the City of Scott City's Fire Department services businesses within its
corporate limits located in or near the Rhodes Industrial Park located east of Interstate 55, and
WHEREAS, the City of Cape Girardeau's Fire Department, pursuant to contract or by
virtue of incorporation of property into its city limits, services businesses located on or near that
part of Route AB/Nash Road located west of Interstate 55, and
WHEREAS, the City of Scott City has a fire truck available to respond to fires on or
near that part of Route AB/Nash Road located west of Interstate 55 and south of the Diversion
Channel normally serviced by the Cape Girardeau Fire Department, and
WHEREAS, the City of Cape Girardeau, Missouri has a fire truck available to respond
to fires in the Rhodes Industrial Park located east of Interstate 55 and SEMO Port Authority, and
WHEREAS, each City, by authority of its Charter or authorizing statutes, has the
authority to enter into this Automatic Mutual Aid Agreement, and
WHEREAS, the execution of this Agreement will increase fire protection to businesses
in the Rhodes Industrial Park, SEMO Port Authority and businesses on Route AB/Nash Road
located west of Interstate 55 and south of the Diversion Channel and is in the best interest of both
municipalities.
NOW, THEREFORE, the parties agree as follows:
The City of Scott City, upon being paged for a fire on or near Route AB/Nash
Road located west of Interstate 55 and south of the Diversion Channel, will automatically
respond to said fire with a fire truck and sufficient firefighters to man the same.
2. That the City of Cape Girardeau, upon being paged, will automatically respond to
any fire calls within the Rhodes Industrial Park on or near Route AB/Nash Road and SEMO Port
Authority, which is located east of Interstate 55, with a fire truck and sufficient firefighters to
man the same.
3. That the Fire Department of each City shall provide the other with a pager to
receive fire calls to the other City from businesses in the Rhodes Industrial Park, SEMO Port
Authority or business located west of Interstate 55 on or near Route AB/Nash Road and south of
the Diversion Channel.
4. Each City shall notify its liability insurance carrier of this Agreement and ensure
that its insurance carrier will cover any injuries or damages arising from said City performing its
obligations hereunder.
5. In the event all of the City of Scott City's fire trucks are responding to another fire
call at the time of notification of a fire on Route AB/Nash Road west of Interstate 55 and south
of the Diversion Channel, the City shall be excused from its obligation under this Contract and
shall promptly notify the Cape Girardeau Fire Department of the conflict, so that the Cape
Girardeau Fire Department may request assistance from other area departments.
6. In the event all of the City of Cape Girardeau' s fire trucks are responding to other
calls at the time it receives notification of a fire in the Rhodes Industrial Park or SEMO Port
Authority, it shall be excused from its obligation under this Contract and shall promptly notify
the Scott City Fire Department, so it may request other departments for assistance.
IN WITNESS WHEREOF, the parties have executed this Agreement by authority of its
respective City Council.
