QUIT CLAIM DEED
THIS QUIT CLAIM DEED is made this =M day of 24l4,rz-i , 20114,
between the CITY OF CAPE GIRARDEAU, MISSOURI, a Municipal Corporation of the State
of Missouri (the "Grantor"), and CAPE LAND & DEVELOPMENT LLC, a Missouri Limited
Liability Company, 2985 Boutin Drive, Cape Girardeau, Missouri 63701, with its principal
office in the City and County of Cape Girardeau, State of Missouri (the "Grantee").
WITNESSETH, that the Grantor, for and in consideration of the sum of One Dollar
($1.00) and other good and valuable consideration, to it paid by the Grantee, the receipt whereof
is hereby acknowledged, does by these presents, Remise, Release and forever Quit Claim, unto
the Grantee, the following described Lots, Tracts or Parcels of land, lying and being situate in the
City and County of Cape Girardeau and State of Missouri, to -wit:
Tract 1:
A Permanent Slope Easement recorded in Book 915, Page 433 in the land records
of Cape Girardeau County, Missouri, as described as follows:
A PART OF THE NORTHEAST QUARTER OF SECTION 34, TOWNSHIP
31 NORTH, RANGE 13 EAST OF THE FIFTH PRINCIPAL MERIDIAN,
CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI,
BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
Commencing at a iron railroad spike at the northeast corner of section 34, said
point being the centerline intersection of Hopper and Kage Roads, thence
along the north line of section 34, N 90° 00' 00" W, 525.81 feet, thence
leaving said section line, S 000 00' 00" W, 30.00 feet to the True Point of
Beginning; thence S 640 5541" E , 188.79 feet; thence S 90° 00'00" E, 125.00
feet; thence N 00° 00' 00" E, 80.00 feet; thence N 90° 00' 00" W, 296.00
feet to the Point of Beginning, containing 0.39 acres more or less. (16,840.00

32" E, 379.96 feet to the beginning of a curve concave to the southwest having a
central angle of 90° 07' 32" and a radius of 20.00 feet; thence along said curve in
a northerly and westerly direction along said curve 31.46 feet; thence N 90° 00'
00" W, 179.70 feet; thence S 00° 00' 00" W, 400.00 feet; thence S 90° 00' 00" E,
198.87 feet to the Point of Beginning, containing 1.83 acres more or less.

TO HAVE AND TO HOLD the same, with all the rights, immunities, privileges and
appurtenances thereto belonging, unto the Grantee, and its successors and assigns, FOREVER,
so that neither the Grantor, nor its successors and assigns, nor any other person or persons for it
or in its name or behalf, shall or will hereafter claim or demand any right or title to the aforesaid
premises or any part thereof, but they and every one of them shall, by these presents, be excluded
and forever barred.
