AN ORDINANCE ACCEPTING PERMANENT UTILITY
EASEMENTS FROM DONGZHI ENTERPRISE INC. , AND
ADVENTUROUS BEAN HOLDINGS LLC, TO SERVICE
SCOOTER' S COFFEE AT 2404 WILLIAM STREET, IN
THE CITY OF CAPE GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1 . The City of Cape Girardeau, Missouri, hereby
accepts, and agrees to accept, two Permanent Utility Easements
to service Scooter' s Coffee located at 2404 William Street, from
the following property owners, in the City of Cape Girardeau,
Missouri, described as follows :

KNOW ALL MEN BY THESE PRESENTS: DONGZHI ENTERPRISE INC. in
consideration of the sum of One Dollar ($1.00) and other good and valuable consideration,
the receipt of which is hereby acknowledged, do hereby grant, bargain, sell and convey to
the CITY OF CAPE GIRARDEAU, MISSOURI, a Municipal Corporation, hereinafter
called the "City", the right, privilege, permission and authority to enter on and upon the
following described property which is solely owned by the undersigned located in the City
and County of Cape Girardeau, Missouri, to -wit:
PART OF OUTLOT 87, U.S.P.S. 2199, TOWNSHIP 30 NORTH, RANGE
13 EAST AND PART OF LOT 1 OF NORTH K SUBDIVISION AS
RECORDED IN PLAT BOOK 14, PAGE 78 OF THE LAND RECORDS
OF CAPE GIRARDEAU COUNTY, MISSOURI, IN THE CITY AND

Said right, privilege, permission and authority to enter in and upon said property
above described is granted for the purpose of enabling the City, its agents, servants and
assigns, to use said property for the management of utilities and for the purpose of enabling
the City of Cape Girardeau, Missouri, its agents, servants and assigns to excavate, build,
maintain, construct, operate, and repair said utilities from time to time, in, on, upon, or
across said described property, together with all the useful, necessary and proper adjuncts,
appurtenances, manholes, and appliances in connection therewith. This easement and the
right, privilege, permission and authority herein granted is perpetual and shall run with the
land.

2021, by and between Dongzhi Enterprise Inc., a Missouri Corporation, of the County of Cape
Girardeau, State of Missouri, Pancake Holding Company, LLC, a Delaware Limited Liability
Company, RJ Development, LLC, a Missouri Limited Liability Company, of the County of Cape
Girardeau, State of Missouri, Martin Ellman and Susanne Ellman, husband and wife, of the
County of Broward, State of Florida, Narvol Randol, Jr. and Amy Randol, husband and wife, of
the County of Cape Girardeau, State of Missouri, GRANTORS, and Adventurous Bean Holdings,
LLC, a Missouri Limited Liability Company, of the County of Cape Girardeau, State of Missouri,
whose mailing address is 282 Timberlake Lane, Cape Girardeau, MO 63701, GRANTEE.
WITNESSETH, that the said Grantors, for and in consideration of the sum of One Dollar
