AN ORDINANCE APPROVING THE RECORD PLAT OF
CAPE ROCK WEST SUBDIVISION
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1 . The record plat of Cape Rock West Subdivision,
being part of Outlot #80, in U. S . P. Survey #2199, Township 31
North, Range 13 East of the Fifth Principal Meridian, in the
City and County of Cape Girardeau, State of Missouri, submitted
by First Missouri State Bank of Cape County, bearing the
certification of Scott A. Richards, a Registered Land Surveyor,
dated the 8th day of September, 2021, including all variances
and exceptions, is hereby approved.
ARTICLE 2 . The City Clerk is hereby directed to sign the
record plat with the date of Council approval and affix thereto
the seal of the City of Cape Girardeau, Missouri .
ARTICLE 3 . This ordinance shall be in full force and effect
ten days after its passage and approval .

Winks Gas station (Acees, Inc.), who leases 2505 Veterans Memorial Dr. from Midamerica Hotels Corporation,
wishes to add Tesla electric vehicle charging stations adjacent to several of the parking stalls along Veterans
Memorial Drive. A portion of the chargers and associated equipment will fall within the public utility easement
along Veterans Memorial Drive.
BACKGROUND/DISCUSSION
Since the Tesla chargers are not a public utility and do not fall under an existing franchise agreement with the
City, it is necessary to execute a license and indemnity agreement.
STAFF RECOMMENDATION
Staff recommends authorizing the City Manager to execute the attached License and Indemnity Agreement with
Midamerica Hotels Corporation and Acees, Inc.
